ALLEGED MATERIAL FALSE STATEMENTS BY BISCO, OI CASE 3

I On November 30, 1994, 01:RIII initiated an investigation into alleged material  !

false statements by Brand Industrial Services Company (BISCO . BISCO is a j vendor of fire penetration seal systems to the nuclear power) industry.

] On September 20, 1994, Clayton W. BROWN, the former BISCO president and now a i

consultant to BISCO, was interviewed during the Dow Corning investigation (OI -

{ Case No. 3-93-028). During the interview BROWN made statements that indicate that BISCO may have made misrepresentations in the qualification testing they )

l conducted at Construction Technology Laboratories (CTL) for their fire pene-i tration seal system.

BROWN stated that 81500 conducted their qualification testing for their fire '

i penetration sesl system at CTL, Skokie, Illinois. According to BROWN, BISCO i constructed the test article at BISCO without any QC supervision by CTL. The i

test article was then transported to CTL, where the test was performed in l CTL's furnace. BROWN commented that to expedite matters in some cases, BISCO would write the test report, which then would be reviewed and critiqued by CTL. BROWN said that the report would be issued under a CTL cover letter.

. BROWN described CTL's role in the fire testing as providing the furnace, i

monitoring tengeratures during the test, and conducting the hose stream test.

" An 01 investigation is being initiated to determine if BISCO made false repre-sentations during the qualification tests provided to the nuclear power indus-try as to CTL's role in the testing process. These tests would be utilized by the licensee to qu'alify the BISCO fire penetration seal system as meeting NRC requirements.

scheduled date for the ARB on this issue. We also need the allegation number  !
