Dear Judge Bloch:

I am hereby forwardino to you a letter dated October 5, 1908 from Duquerne Light Company (DLC) which responds to matters raised in your order of August 25, 1988 in this proceeding. In the letter, DLC reiterates its previous statements in 1087 letters to NRC on the record in this proceedino, that (a) OLC does not intend to resubmit a facility certification NRC Fom 308 for Mr. Held's application for an SRO license for Beaver Valley Nuclear Station. Unit 1 which DLC withdrew by letter dated November 12,198' / . nor (b) does DLC intend to pursue dual operator licenses for the two units of Beaver Valley as state:I in DLC's letter of November 28, 1987.

Consequently. in Itght of the lack of certification of need from DLC as required by 10 C.F.R. I 55.31(4), the Staff will nct be able to issue an SRO license to Er, Held for Unit I at Beaver Valley.

Docket Nos. 50-334/50-412 License Nos. DPR-66/NPF-73 SRO License on BVPS Unit 1 for Mr. David Held Docket No. 55-60402, License SOP 10660 Gentlemen Your correspondence dated September 12, 1988 references a presiding Administrative Judge Memorandum and Final Order indicating that Mr. Held passed the simulator portion of his examination for Senior Reactor Operator for Beaver Valley Unit 1.

The Memorandum and Final Order authorized the Director of Nuclear Reactor Regulation to issue a SRO license to Mr. Hold for Beaver Valley Unit 1 upon a finding by the Director that Mr. Held has met all other applicable requirements or 10 CFR Part 55. The Memorandum and Final Order also directed the NRC staff to convey to Duquesne Light Company the presidir.g judge's request that Duquesne Light Company submit in writing to the Director of NRR any clarification that it consider appropriate concerning whether it has any current or anticipated need to use Mr. Held as a SRO on Beaver Valley Unit 1.

Duquesne Light Company has withdrawn its facility certificction that accompanied Mr. Held's application for a SRO license for Beaver Valley Unit 1 and also previously indicated that Beaver Valley is not pursuing dual licensos for the two units at the Beaver Valley Nuclear Power Station.

Mr. Held is actively using his current Unit 2 SRO license and Duquesne Light Company does not intend to resubmit a Form 398 concerning Mr. Held's qualification to act as a SRO for Unit 1.
