,CPPOSITION TO SPECIFICATION OF CLAIMS The NRC staff hereby notifies the Administrative Judge and Mr. Held of the withdrawal of the Staff's opposition to the specification of claims filed by Mr. Held on October 3, 1987.

On August 8, 1988, the Commission remanded this proceeding to the Administrative Judge "on the specific issue of whether Mr. Held should have been found to have passed or failed the simulator examination

[ administered in July 1986]." 1/ In view of the remand of this matter by the Comission, the Staff has reevaluated its position concerning the results of the simulator exsmination. After due consideration of the specific simulator exaraination deficiencies at issue, the passage of time since the examination was administered and the problems associated with specific recollection, Mr. Held's success in the Beaver Valley Unit 2 SRO examination, and Mr. Held's successful performance as an SRO at Beaver

g Valley Unit 2, the Staff withdraws its objection to Mr. Held'3 request that he be considered as having passed the simulator examination for SR0 at Beaver Valley Unit 1. The Staff believes that no hearing need be held and that an unopposed decision can be issued authorizing the Director of NRR to issue an SR0 license to Mr. Held for Unit 1, upon a finding by the Director that Mr. Held has met all other applicable requirements in 10 CFR Part 55, 2/.
