This letter and its Attachments constitute an application for amendment to the Wolf Creek Generating Station (WCGS) Facility Operating License No. NPF-42.

The application proposes to modify the effective full implementation date for Amendment No. 120 from December 31, 1999 to June 30, 2000. Amendment No. 120 (Reference) revised the WCGS Technical Specifications to increase the storage capacity of the spent fuel pool and increase the nominal fuel enrichment to  ;

5.0 weight percent of U-235.

l Amendment 120 states: "The license amendment is effective as of its dute of I issuance to be fully implemented no later than December 31, 1999, except that i the racks in the cask loading pit may be installed at a future time after the completion of the next refueling outage." Wolf Creek Nuclear Operating Corporation (WCNOC) requests that the implementation completion date for Amendment No. 120 be revised to June 30, 2000.

The requested change to the implementation completion date is necessary due to d . lays in the contractor's completion of a similar re-rack project at another utility, plus the contractor's vendor fabrication, and subsequent delivery, of the new spent fuel storage racks for WCGS. These unexpected delays were encountered at a similar re-racking project at another utility's site and have resulted in the vendor's unavailability to start work at WCGS to support a December 31, 1999 implementation completion date.

l This delay is not expected to impact the implementation date requirement of WCGS Technical Specification Amendment No. 123 (conversion from the current Technical Specifications to the improved Technical Specifications) requiring the amendment be implemented by December 31, 1999. WCGS expects to have sufficient new fuel rack capacity installed to accommodate storage of the current spent fuel inventory to support implementation of the improved j Technical Specifications. The proposed date of June 30, 2000 will allow for / COf complete installation of the new spent fuel storage racks in the WCGS Spent i Fuel Storage Facility, consistent with the license condition, and supports a scheduled delivery of fresh fuel for Cycle 12 operation.

Proposed Change Th'e proposed change modifies the effective implementation date for Amendment No. 120 from December 31, 1999 to June 30, 2000. Amendment No. 120 revised the Wolf Creek Generating Station (WCGS) Technical Specifications to increase

the storage capacity of the spent fuel pool and increase the nominal fuel enrichment to 5.0 weight percent of U-235.

Evaluation The approved amendment request (Amendment No. 120) allows for the removal of the current spent fuel storage racks and the installation of new racks capable of increasing overall storage capacity of the spent fuel pool. The new racks accomplish this by increasing the fuel assembly storage density while maintaining a sub-critical array.

The requested change to the implementation completion date is necessary due to delays in the contractor's completion of a similar re-rack project at another utility, plus the contractor's vendor fabrication, and subsequent delivery, of the new spent fuel storage racks for WCGS. These unexpected delays were encountered at a similar re-racking project at another utility's site and have resulted in the vendor's unavailability to start work at WCGS to support a December 31, 1999 implementation completion date.

No Significant Hazards Consideration Determination The following Standards identified in 10 CFR 50.92 have been used to determine whether the proposed change involves a Significant Hazards Consideration. The proposed change is evaluated against the three Standards.

Standard I - Involve a Significaut Increase in the Probability or Consequences of an Accident Previously Evaluated The proposed change is administrative in nature and does not significantly affect any system that is a contributor to initiating events for previously evaluated accidents. The proposed change does not significantly affect any system that is used to mitigate any previously evaluated accidents.

Therefore, the proposed change does not involve any significant increase in the probability or consequence of an accident previously evaluated.

Standard II - Create the Possibility of a New or Different Kind of Accident from any Accident Previously Evaluated The proposed change is administrative in nature and does not alter the design, function, or operation of any plant component and does not install any new or different equipment. Therefore, a possibility of a new or different kind of accident from those previously analyzed has not been created.

' Attachment 1 to ET 99-0035 Page 2 of 2 Standard III - Involve a Significant Reduction in the Margin of Safety The proposed change is administrative in nature and does not involve a si'gnificant reduction in the margin of safety associated with the fuel l . cladding, reactor coolant boundary, containment, or any safety limit.

l l Environmental Impact Determination l 10 CFR 51.22(b) specifies the criteria for categorical exclusions from the

. requirement for a specific environmental assessment per 10 CFR 51.21. This amendment request meets the criteria specified in 10 CFR 51. 22 (c) ( 9) as specified below:

(i) the amendment involves no significant hazards consideration As demonstrated above, the proposed change to the implementation date does not j involve any significant hazards consideration.

l~ (ii) there is no significant change in the types or significant increase in

( the amounts of any effluents that may be released offsite The proposed change to'the implementation date does not involve a change to the facility or operating procedures that would cause an increase in the amounts of effluents or create new types of effluents.

l (iii) there is no significant increase in individual or cumulative occupational radiation exposure The proposed change to the implementation date is administrative in nature and does not result in an increase in individual or cumulative occupational radiation exposure.

Conclusion i

The No Significant Hazards Consideration Determination and the Environmental l Impact Determination conclude that operation of Wolf Creek Generating Station, l with implementation date of June 30, 2000, to complete the installation of new l spent fuel storage racks, does not involve any significant hazards consideration as defined in 10 CFR 50.92, nor is there an impact on the environment, as the change meets the criteria specified in 10 CFR 51.22 for a categorical exclusion from the requirements of 10 CFR 51.21 relative to requiring a specific environmental assessment by the Commission. l l

1. The Nuclear Regulatory Commission (the Commission) has found that:

A. The application for amendment to the Wolf Creek Generating Station (the facility) l Facility Operating License No. NPF-42 filed by the Wolf Creek Nuclear Operating '

Corporation (the Corporation) dated March 20,1998, as supplemented by letters dated May 28 June 30, August 28, September 4, November 20, and December 8, -

1998, complies with the s*Jandards and requirements of the Atomic Energy Act of ,

1954, as amended (the Act), and the Commission's rules and regulations set forth  ;

in 10 CFR Chapter I; B. The facility will operate in conformity with the application, as amender , the provisions of the Act, and the rules and regulations of the Commissioii; C. There is reasonable assurance: (i) that the activities authorized by :his Omendment can be conducted without endangering the health and safety of the public, ..t pi) that such activities will be conducted in compliance with the Commission's regulations; D. The issuance of this license amendment will not be inimical to the common defense and security or to the health and safety of the public; and E. The issuance of this amendment is in accordance with 10 CFR Part 51 of the Commission's regulations and all applicable requirements have been satisfied.

2. Accordingly, the license is amended by changes to the Technical Specifications as indicated in the attachment to this license amendment and Paragraph 2.C.(2) of Facility Operating License No. NPF 42 is hereby amended to read as follows:
2. Technical Specifications The Technical Specsfications contained in Appendix A, as revised through l Amendment No. 120 , and the Environmental Protection Plan contained in Appendix B, both of which are attached hereto, are hereby incorporated in the license The Corporation shall operate the facility in accordance with the Technical Specifications and the Environmental Protection Plan.
