MEMORANDUM IN SUPPORT OF WEST ~ VALLEY AGRICULTURAL PROTECTION COUNCIL, INC.'S MOTION SEEKING DIRECTED CERTIFICATION OF INTERLOCUTORY APPEAL As indicated in the accompanying motion, the Appeal Board denied a motion by West Valley to stay the July 11, 1983 decision of the Atomic Safety and Licensing Board on the ground that the motion was premature. Now that the Licensing Board has denied West Valley's motion for certification, West Valley has filed this motion seeking directed certification. In support of the motion, West Valley resubmits the original memorandum of law it submitted in support of its motion seeking a stay. A copy of that memorandum is annexed hereto as Appendix A to this motion.

West Valley would like to discuss only one additional point. In its opposition to West Valley's motion seeking certification of an appeal from the Licensing Board, the NRC 8309010156 830827 PDR ADOCK 05000529 0 PDR

staff cited cases to-the effect that interlocutory review will be limited to two situations, one of which is a situation which could affect the basic structure.: of the proceeding in a pervasive and unusual manner. Houston Light and Power Co.

(Allens Creek, Unit 1), ALAB-635, 13 NRC 309 (1981) citing Public Service Company of Indiana (Marble Hill, Units 1 and 2),

ALAB-405, 5 NRC 1190, 1191-1192 (1977). As pointed out in the accompanying memorandum of law, proceeding with a hearing where there is an inadequate EIS would affect the basic structure of this proceeding in such a manner. As a result, this case meets the NRC's requirements for directed certification of an appeal.

Conclusion For the foregoing reasons set forth in this memorandum and in the memorandum attached as Appendix A, the Appeal Board should grant West Valley's motion and direct the Licensing Board to certify an appeal on the issues raised in'the July 11, 1983 Licensing Board decision.
