et al. ("Licensces") respectfully move the Board in the above-captioned proceeding to compel Intervenors to respond to

" Licensees First Set of Intorrogatories" and request that this motion be considered on an expedited basis duo to the limited time still remaining for di  :

/ery in this proceeding.

In its Memorandum and Order following a Prehearing conference, the Board authorized discovery in this procooding to i

e begin on August 1, 1991, and ordered that the discovery "must be completed by September 15, 1991."

2 Interrogatories and Requests Tor Production of Documents" were served by hand delivery upon Counsel for Intervenors. Pursuant to 10 CFR 2.740b, responses to Liconeses' interrogatories were due to be served upon Licensees on August 26, 1991. Licensees have not receivod any response prior to filing this motion.

Licencess are preparing for the hearing in this proceeding and require Intervenors' response to Licensees' interrogatories in order to continue and complete their discovery prior to September 15, 1991. In. light of the short time ,

remaining for the conduct of discovery, counsel for Licensees attempted to contact Intervenors' C'ounsel by telephone during mid-morning on August 20, 1991, in order to obtain Intervenors' response, but the telephone was answorod by a machine. Counsel for Licensees again attempted to contact Intervanors' Counsel on August 29, 1991, by a letter sent by facsimile transmission. See Attachment A. There has been no response to the interrogatories, the mossage left on the answering machine, or the letter.

Licensees respectfully request that the Board compel Intervenors to respond to Licensees' interrogatories by hand delivery or facsimile transmission no later than 5:00 PM on Tuesday, September 3, 1991. Additionally, Licensees ask that the Board exercise its authority under 10 CFR 2.711 to dispense with l

Written responses to this motion and hear oral arguments on this motion by telephone conference as soon as practicable. Licensees believe there is good cause to exercise such authority, in order l
