SUFFOLK COUNTY MOTION TO ESTABLISH REGULAR HEARING SCHEDULE Suffolk County hereby requests that the Board establish a regular daily schedule for the hearings conducted in this pro-ceeding.1/ The County submits that the hearings should run from 9:00 a.m. until 5:00 p.m., Wednesdays through Fridays, and from 10:00 a.m. to 6:00 p.m. on Tuesdays.

Although there may be special circumstances to justify an alteration in this schedule, which can be considered on a case-by-case basis as they arise, the County believes that a: regular-practice of having hearings last-from 9:00 a.m.:to 6:00'p.m. or later, as has occurred in the past,_is undesirable for several.

reasons. First, assuming a one-and-one-halfchour lunch break, such a schedule amounts to seven and one-half hours of actual trial proceedings for'fourfstraight days. That-is a1 brutal' '

/

The County considered raising this matter orally at the recommencement of-the hearing on' March 27, but' decided. Lit would-be better first to< provide the Board with the County's viewsLon

the subject 1so the Board would be; aware of them_ prior to-

!. discusssing the ' matter at the -hearing.

schedule for both witnesses and lawyers who are required to spend several additional hours every evening (and during the lunch breaks) engaged in trial preparation activities.

Second, when the proceedings to beyond 5:00 p.m., the atten-tion span and effectiveness of all concerned (witnesses, lawyers and the Board) decreases and the quality of the record deterio-rates as people become fatigued.

The County believes that an eight-hour hearing day running from 9:00 a.m. to 5:00 p.m. (or 10:00 a.m. to 6:00 p.m.) is reasonable and sufficiently long, and should be adopted by the Board.

Respectfully submitted, Martin Bradley Ashare Suffolk County Department of Law Veterans' Memorial Highway Hauppauge, New York 11788
