10 CFR 72.30 Submittal - Zion Nuclear Power Station This letter confirms a conversation between Mr. John Hickman (NRC) and Mr. Donald Beckman regarding ZionSolutions' (ZS's) approach to implementation of the requirements of 10 CFR 72.30, "Financialassurance and recordkeepingfor decommissioning," regarding Independent Spent Fuel Storage Facilities (ISFSI) decommissioning funding planning as described in 76 FR 35512.

The contractual agreements between the Exelon Generating Company (EGC) and ZS place eventual responsibility for decommissioning of the ZNPS ISFSI with EGC sometime many years after possession of the ISFSI and its contained fuel is transferred from ZS to EGC in 2020. Since ZS will continue to hold the license until that time, ZS and EGC are currently discussing how to most appropriately provide the necessary information to the NRC.

As of December 17, 2012, 10 CFR 72.30 will require all "applicants for" and "holders of' a Part 72 license to submit a decommissioning funding plan ensuring adequate funds are available for decommissioning of an ISFSI. ZS, as a Part 50 licensee, is not required to apply for a Part 72 license, and will not become a holder of a Part 72 license until such time as fuel is first stored at the future ISFSI facility. ZS anticipates the first fuel will be transfer to a licensed canister and stored at the ISFSI facility in 2013. Following fuel storage on the ISFSI pad, the NRC will be provided with a decommissioning funding plan for the Zion ISFSI facility as required under Part 72.30 consistent with the outcome of the EGC-ZS discussions above. Prior to fuel transfer and storage, ZS will advise the NRC as to whether EGC will report on Part 72.30 decommissioning funding assurance directly to the NRC or whether EGC's estimate will be included in the ZS March 31 report following first fuel transfer to a licensed canister.
