(Davis-Besse Power, Station, Units 2 ) NRC Docket Nos. 50-500A and'3) ) 50-501A APPLICANTS' REPLY TO MOTION BY NRC STAFF TO AUTHORIZE THE ATOMIC SAFETY AND LICENSING BOARD TO CONSIDER AND RULE ON CONSOLIDATION

1. In a motion dated June 16, 1975, the Regulatory Staff moved the Commission for an order to direct and authorize the Atomic Safety and Licensing Boards sitting in the above-captioned proceedings to decide whether the Davis-Besse Units 2 and 3 proceeding should be consolidated with the on-going Perry Units 1 and 2 and Davis-Besse Unit 1 proceed-ings (hereinafter "the Perry Proceeding").
2. Subject to the conditions set forth below the Applicants in the above-captioned proceedings have no objec-tions to the entry of the order requested by the Regulatory Staff and to consolidation of the captioned proceedings.

3. While the Licensing Board in the Davis-Besse Units 2 and 3 proceed,ing, in an order' dated May 22, 1975, has established that the matters at issue for purposes of discovery are identical to those previously established for the same purpose in the Perry Proceeding, Applicants hereby maintain their objection to the adequacy of that articulation of the matters in issue for purposes of determining the matters ultimately to be controverted in either or both the Davis-Besse Units 2 and 3 proceeding and the Perry Proceeding. Those issues fail to conform with the specificity requirements set forth in the Com-mission's Rules of Practice in 10 CFR 552.714 and 2.752.
4. Applicants' agreement to consolidation of the captioned proceedings is conditioned on no enlarge-ment of the matters at issue and no expansion of the already broad scope of discovery allowed in the Perry Proceeding. Applicants reserve the right to carry out a second round of discovery in the Davis-Besse Units 2 and 3 proceeding. The Department of Justice has already initiated such an additional discovery activity in that proceeding.
5. While Applicants, subject to the foregoing conditions, do not object to consolidation, it should be recognized that such consolidation could imperil the pre-sent very tight Perry Proceeding schedule. Accordingly,

we respectfully submit that the fundamental purpose of consolidation, i e., the desire to avoid the cost of essentially redundant proceedings, can be accomplished by other means. In our view the Commission could direct the Licensing Board to proceed.with the Perry Proceeding issues in the context of the Davis-Besse Units 2 and 3 proceeding with such expansion of the issues or schedules as the Licensing Board may deem appropriate. At the same time, the Commission could formally terminate the ongoing Perry' Proceeding on the condition, to which we would stipulate, that the units involved in that proceed-ing would be subject to the final decision rendered in the Davis-Besse Units 2 and 3 proceeding. In this manner, the Commission could assure that there would be no delay in the commencement of construction of the Perry facilitics without any detriment to the public interest and to those other interests represented by the other parties in the captioned proceedings. The suggested proceeding would allow a full antitrust hear-ing to proceed and would allow all interested parties a fair-opportunity to present and argue their respec-tive positions.
