.VOTION FOR EXTENSION OF TIME WITHIN WHICH TO FILE APPEAL The City of Gary, Indiana, Uni'ed Steelworkers of America Local 6787, the Bailly Alliance, cave the Dunes Council, and the . Critical Mass Energy Project '1ereby move for a four-day extension of time, to and including August 29, 1980, within which to file an appeal from the Order of the Licensing Board (dated August 8, 1980) which denied the instant petitioners' i

motion to intervene. In support of this motion, petit sners City of Gary, et al. state the following:

1. This is a 3roceeding involving the request by Northern l

Indiana Public Service Company for an amend aent of its construc-tion permit for the Bailly Gcnerating Sta. ion, Nuclear 1, which would extend the latest date for completion of the facility from September 1, 1979 to December 1, 1987. See 44 Fed. Reg. 69061 (Nov. 30, 1979)

2. Following the subruission of timely petitions to inter-vene by the City of Gary, et al. and others, on March 12 and 13, 1980, the Licensing Board held a special Prehearing Confer-ence to discuss the intervention petitions. pSO3 S

3. On August 8, 1980, the Licensing Board issued an

, Order denying intervention to the City of Gary, et al. The Board ruled that the one contention petitioners raised--whether populations surrounding Bailly could be evacuated in the case of'an accident--was beyond the scope of this proceeding.

4. The extension of time requested for the filing of petitioners' appeal is made necessary by the press of counsel's other work and the fact that the attorney. principally handling the appeal has been unavailable due to illness.
5. Moreover, the requested extension will not significantly delay the proceedings herein. The Licensing Board has also issued a Notice of Hearing on Amendment of Construction Permit (August 14, 1980), indicating that a hearing will be scheduled in the near future and thus that proceedings will go forward, albeit in the abs ence of the Gary petitioners.
6. Counsel for the NRC staff, Steven Goldberg, has author-ized us to state that he has no objection to the requested extens ion .

For all the foregoing reasons, this motion for a four-day extension of time should De granted.
