ATLANTIC COUNTY'S RESPONSE TO MEMORANDA' DATED OCTOBER 27, 1978 On October 27, 1978, Chairman Hendrie and Commissioner Gilinsky filed memoranda which discussed their involvement with the captioned application prior to their respective appointments to the Commission.

The Memoranda requested objections to participation.

The Intervenor, Atlantic County, has no factual ~ basis on which to object. However, the~ failure of Atlantic County to enter an objection shall not be deemed a legal waiver of any action by the Commissioners which may be arbitrary, capricious, unreasonable or tainted with conflict.
