INTERVENOR, ACCCE'S, RESPONSE TO APPLICANI'S NOTION (#9) TO ESTABLISH HEARING SCHEDULE Intervenor, ACCCE, has detemined that in light of the decision by Public Service Electric and Gas Company to withdraw its order for floating nuclear power plants which the Utility had intended to construct off the coast of New Jersey, ACCCE will no longer expend its very limited resources by continuing to actively participate in the present licensing hearings in the within proceeding.

Ibwever, this decision by ACCCE is contingent upon the continuing absence of any real prospect for installation of such nuclear power generating stations off the New Jersey Coast.

Accordingly, intervenor will remain as a party to these proceedings and may exercise its rights to participate fully in these proceedings at a later time should such action be deemed appropriate to protect the health, welfare and safety of the residents of New Jersey.

In the interim, intervenor, ACCCE, does not oppose the adoption 0 any reasonable schedule by the Board to adjudicate the substantial environnental issues presently before it for such resolution.
