NATURAL RESOURCES DEFENSE COUNCIL OPPOSITION TO APPLICANT'S MOTION TO DISMISS CONTENTION Mea culpa.
We missed the filing deadline.
We could offer a number of explanations but they do not alter that fact.
Missing the deadline has cost the applicant time.
It is perhaps entitled to recapture some of that time, but it is not entitled to have the contention dismissed.
The penalty for missing a single filing deadline is not that that party loses its entire case.
We believe the Board could impose a penalty on NRDC which would take time from its schedule for filing a reply brief or otherwise reduce time available to it in the proceeding.
It is 1/ Explanations would include:
1.
Press of other matters causing neglect of briefing schedule.
2.
Staff statements at prehearing conference (7/27/78) that FES III would not be published until design details on core catcher'were provided, creating false sense of security.
3.
Pendency of Class'9 issue and the OPS indication of intent to proceed with appeal, eliminating the necessity for strict deadlines and thus creating a changed circumstance warrant-ing abrogation of the briefing schedule.
2/ The deadline was for filing a mo tion for summary disposition.
Failure to meet it could at most result in denial of the right to file the motion.

2 our intention to proceed with briefing the NRDC contention, the brief to be filed on February 16, 1979.
We trust the Board will allow the contention to which the brief is related to remain in the proceeding.
