INTERVENORS' RESPONSE TO ORDER SETTING ORAL ARGUMENT _

Intervenors reque.st that oral argument be postponed for not less than sixty (60) days. The principle reason for the requested length is that Intervenors have no funds to pay for the expense of a trip to Washington, D.C. The limited funds Intervenors have is being devoted to the very substantial costs being and to be. incurred for the safety hearings. This aspect of the hearings has been lengthy and will restart probably in early February 1979 and last for another long period.

In addition, to the above Intervenor's attorney on appeal has two trials and a probate matter previously set on January 30, 1979. The NPDES prehearing conference for this facility (Black Fox) is set for January 25, 1979, and the judge in that matter has required certain additional filings within a few days thereafter.
