. FILE SUPPLEMENTAL BRIEF

1. On January 12, 1978, the Atomic Safety and Licensing Appeal Board issued an order granting leave to all parties in the above captioned antitrust proceeding to file a supplemental brief discussing the applicability to this case of the Appeal Board's recent antitrust decision in Consumers Power Co. (Midland Plant, Units 1 and 2) , ALAB-452, 6 NRC (December 30, 1977).

The time for filing is to be on or before February 13, 1978.

2. The Applicants herein do desire to make such a sup-plemental filing. Mcwever, due to the press of other unrelated matters currently pending in both state and federal courts, re-quiring briefs to be filed in the first weeks of February, 1973, 8002 250 h r>7

.T it is now clear that the undersigned counsel will be unable to complete Applicants' supplemental brief by February 13. More-over, weather conditions in Ohio and Pennsylvania pose an ad-ditional problem for Applicants in terms of coordinating their positions and their review of the brief prior to filing.

3. Accordingly, Applicants hereby request an addi-tional two weeks, or until on or before February 27, 1978, within which to complete and file their supplemental brief. In view of the Appeal Board's requirement of simultaneous filings, it is our understanding that any other party desiring to file a sup-plemental brief would similarly have until February 27 to do so.

WHEREFORE, Applicants respectfully request the Appeal Board to grant their motion to extend the time for filing a sup-plemental brief to and including February 27, 1978. The under-j signed counsel has been advised by counsel for the Department of Justice and by counsel for the Staff of the Nuclear Regulatory Commission that they do not oppose this request. Counsel for Intervenor, the City of Cleveland, has advised that the City is opposed to the requested extension.
