By its Order of January 23, 19761 the Special Board appointed to i

consider the suspension of the law firm of Squire, Sanders & Dempsey established a date for hearing oral argument regarding suspension and stated that the procedure to be followed "will be the same as that followed l'

counsel for Squire, Sanders & Dempsey served by mail- an application for subpoena for.Mr. Howard J. Holton and a letter to Chairman Bowers stating that Squire, Sanders & Dempsey would offer the testimony of l

. Messrs. Lansdale, Brueckel and Holton in these proceedings. City of Cleveland (Cleveland) opposes this attempt by Squire, Sanders & Dempsey to ignore this Board's Order of January 23, 1976.

Thi Board's Order clearly states that the procedure to be followed will be the same as that followed at the December 31, 1975 hearing. The De cember 31, 1975 hearing was limited solely to oral argument on Cleveland's motion to disqualify Squire, Sanders & Dempsey from repre-senting or aiding any party representing an Applicant in these proceedings.

The matter has been fully briefed and is ready for decision. Taking oral testimony can only result in delaying final resolution of Cleveland's motion.-

Accordingly, Cleveland urges this Board t'o limit the proceedings to oral argument, ,

Cleveland has had no opportunity to engage in discovery directly  ;

related to the issues now pending before this Board. Any attempt by Cleveland to obtain discovery has been met with claims of privilege and irrelevance. Only limited discovery was permitted which would relate to Cleveland's efforts to sell $9. 8 million of bonds for rehabilitation of the municipal light plant. Such evidence as Cleveland has developed has been obtained by chance in discovery obtained not from Squire, Sanders & Dempsey, l

but from The Cleveland Electric Illuminating Company (CEI). If this pro-ceeding is to be opened at the last minute, for the taking of evidence, it is i

imperative that Cleveland have an opportunity to discover such documents l

relevant to the issues herein which may exist. Squire, Sanders & Dempsey's

eleventh hour announcement of its intention to present testimony has in effect denied Cleveland the opportunity to depose the prospective witnesses prior to their testifying. Such discovery is necessary if Cleveland is to be able to engage in meaningful cross-examination of the witnesses called

- by Squire, Sanders & Dempsey. Accordingly, Cleveland makes this alternative application of subpoenas duces tecum to:
