SOUTH TEXAS PROJECT, UNITS 1 AND 2 - RE: WITHDRAWAL OF REQUEST FOR AMENDMENTS (TAC NOS. MC3923 AND MC3924)
Dear Mr. Sheppard:
By letter dated August 2, 2004, STP Nuclear Operating Company (STPNOC) applied for amendments to South Texas Project (STP), Units 1 and 2, Operating Licenses NPF-76 and NPF-80, respectively. The proposed changes were to modify the facility technical specifications (TSs) to implement a risk-informed process for determining allowed outage times for STP, Units 1 and 2, TSs. The risk-informed process involves the application of the STP, Units 1 and 2, Configuration Risk Management Program (CRMP). The STP CRMP is a procedurally controlled program utilized for the implementation of paragraph 50.65(a)(4) of Title 10 of the Code of Federal Regulations. Subsequently, by letter dated June 6, 2006, STPNOC submitted a revised license amendment request. The revision reflected the changes to the original scope and content of the application, the results of the STPNOC and Nuclear Regulatory Commission (NRC) discussions, the incorporated responses to the NRC questions, and the results of the NRC/Industry/STPNOC discussions on Electric Power Research Institutes Risk Managed Technical Specification Guidelines that are a substantial part of the basis of STPNOCs application. The application was resubmitted in its entirety.
In a telephone conversation between Mr. Scott Head of your staff and me, it was agreed that the June 6, 2006, application would supercede the August 2, 2004, application, and the August 2, 2004, application would be withdrawn. Unless you notify the NRC that this information is incorrect by August 9, 2006, we will consider the August 2, 2004, application to be withdrawn. At that time, we will file a Notice of Withdrawal of Application for Amendments to Facility Operating Licenses NPF-76 and NPF-80 with the Office of the Federal Register for publication, and close the task action commitment (TAC) numbers for your August 2, 2004, application. We will proceed to process your revised application dated June 6, 2006, under new TAC numbers.
