Letter from Jane Marshall, NRC, to George Vanderheyden, Calvert Cliffs Nuclear Power Plant, dated July 28, 2005, "Extension Request for the Foreign Obligations Reporting Requirement" Reference 1 informed STP Nuclear Operating Company (STPNOC) that by accepting, installing and utilizing the reactor vessel closure heads from Mitsubishi Heavy Industries, Ltd. from Japan in each South Texas Project unit, STPNOC then has a responsibility for notifying the Nuclear Materials Management and Safeguards System (NMMSS) within 30 calendar days of re-starting the reactor with Japanese-obligated equipment that all material used in and produced through the use of the reactor is obligated to Japan. All nuclear material transaction and status reports must be applied accordingly.

The purpose of this letter is to request a change to the timing of the 30 calendar day reporting requirement. STPNOC requests that we be allowed to provide this information at the same time we provide the annual physical inventory report with one exception as discussed below. A 30 day reporting requirement places unnecessary burden on the Reactor Engineering organization. Reactor Engineering at the South Texas Project (STP) is responsible for all NMMSS required reports. Reactor Engineering at STP is also responsible for on shift coverage of outage fuel movements, startup test, power ascension testing, and 100% power testing. STP has scheduled its annual physical inventories to coincide with periods when Reactor Engineering resources are available to make necessary Special Nuclear Material (SNM) database updates, generate, review and approve required NMMSS reports. This extension would allow the Nuclear Material Transaction Report for Japanese-obligated nuclear material to be generated at the same time as other required NMMSS reports and when Reactor Engineering resources are available.

NOC-AE-0800231 0 Page 2 If approved, the first report concerning Japanese-obligated nuclear material would be provided by January 15, 2010, following replacement of the Unit 1 reactor vessel head during the Fall 2009 Refueling Outage. This is a one-time exception from this request to provide the information at the same time as the annual physical ihventory report and is greater than 30 calendar days after the planned completion of the Unit 1 outage. The second report would be provided by October 1, 2010 (the annual physical inventory reporting date for the STP units), following replacement of the Unit 2 reactor vessel head during the Spring 2010 Refueling Outage., Reports thereafter would be provided at the annual physical inventory reporting date.

Please provide a response to this request by June 1, 2009 so that we can adjust our procedures and provide the appropriate report when required.

This request is similar to a request approved for the Calvert Cliffs Nuclear Power Plant (Reference 2).
