SUMMARY

OF PUBLIC PHONE CALL ON JULY 18, 2018, WITH THE NUCLEAR ENERGY INSTITUTE REGARDING CONTROLLED UNCLASSIFIED INFORMATION On July 18, 2018, the U.S. Nuclear Regulatory Commission (NRC) staff held a public phone call with the Nuclear Energy Institute (NEI). A representative of PSEG also attended the call. The purpose of the call was to provide a status update on the NRCs efforts to implement the Controlled Unclassified Information (CUI) Rule (32 CFR 2002).

The following information was communicated to the attendees by the Office of Nuclear Reactor Regulation (NRR) CUI Project Manager:

1. The NRC is implementing the National Archives and Records Administration (NARA)

CUI Rule, 32 CFR Part 2002 - Controlled Unclassified Information (published 2016) through an agency-wide Working Group led by the Office of the Chief Information Officer (OCIO).

2. The current status of the NRCs implementation is discussed in INFO SECY-18-0035, (March 2018), Update on Development of the Controlled Unclassified Information Program (Agencywide Documents Access and Management System Accession No.

ML18065B107).

3. The CUI Rule sets forth government-wide requirements on agency handling of information thats not classified, but still requires safeguarding or dissemination controls.
4. CUI will replace the current sensitive unclassified non-safeguards information (SUNSI) program. CUI will impact NRC staff and contractors and non-Executive agencies with whom the NRC shares CUI through written agreements.

D. Morey 5. CUI will have the biggest impact on NRC employees and contractors. The impact on licensees and other external stakeholders will depend on the type and quantity of sensitive information the licensee or stakeholder uses.

The Working Group has four Sub-Working Groups:

1. Management Directive Sub-Working Group: This subgroup is currently revising MD 12.6, currently titled NRC Sensitive Unclassified Information Security Program. When published, the new title for MD 12.6 will be, NRC Controlled Unclassified Information Program. In addition, MD 12.6 will reference detailed guidance internal procedures for staff and contractors to follow regarding markings, cover pages, and other key elements that are required to meet the CUI Rule.
2. Communications Sub-Working Group: This subgroup prepared a draft Communications Plan to describe methods and tools the staff will use to communicate with internal and external stakeholders prior to the NRCs implementation of the CUI Rule.
3. Process Development Sub-Working Group: The purpose of this subgroup is to develop the internal processes required to implement the CUI Rule. This includes, as examples, an Incident Management Process, the Challenge Process, a Self-Inspection Process, and the Waiver Process. The subgroups efforts related to the development of these internal processes was recently initiated.
4. Rulemaking Sub-Working Group: The purpose of this subgroup is to review the NRC regulations that may need to be revised as a result of CUI implementation. Any changes to NRC regulations as a result of rulemaking efforts will be coordinated through the NRCs rulemaking process, which includes opportunities for public comment.

Other Working Group Efforts:

1. There is new NARA guidance for transmitting CUI electronically, so the working group is reviewing the guidance to consider how it aligns with revisions being proposed in MD 12.6.
2. A training program for staff.

UPCOMING:

Draft CUI Policy Development The staffs development of a high-level draft CUI policy statement for Commission review and approval by September 2018, is described in SECY-18-0035. The working group was working towards this goal.

Overall goal: Fully implement the NRCs CUI program by the end of 2020.
