SUMMARY

OF PUBLIC PHONE CALL ON OCTOBER 9, 2018, WITH THE NUCLEAR ENERGY INSTITUTE REGARDING PLANNING FOR THE NOVEMBER 2018 INSPECTION WORKSHOP On October 9, 2018, the U.S. Nuclear Regulatory Commission (NRC) staff held a public phone call with the Nuclear Energy Institute (NEI) and other stakeholders. The purpose of the call was to discuss the November 15, 2018, inspection workshop. The workshop would address the inspection activities related to digital instrumentation and controls (I&C) modifications performed under the Alternate Review Process introduced in Digital I&C Interim Staff Guidance (ISG)-06, Licensing Process, Revision 2.

Before the workshop planning portion of the meeting, the staff provided stakeholders with an update to some of the changes that have been made to the ISG since the September 19, 2018, public phone call (Agencywide Documents Access and Management System (ADAMS)

Accession No. ML18275A042). The staff verbally provided the following changes that were made to the ISG-06:

The last paragraph of Section C.2, Alternate Review Process Overview, was revised as follows:

Under the Alternate Review Process, it may be appropriate to escalate a licensees regulatory commitment (see Section C.2.2) to a legally binding regulatory requirement in the form of a license condition based on the determination by NRC staff that the issue is of high safety or regulatory significance. Therefore, the staff should evaluate licensee regulatory commitments related to design, implementation, and testing activities as potential license conditions, to address issues of high safety or regulatory significance, per NRR Office Instruction LIC-101, Section 4.4, Regulatory Commitments and License Conditions. NRR Office Instruction LIC 101, Section 4.4, also provides guidance on those regulatory commitments that dont warrant escalation to a license condition but are relied on by the staff as an element of the staffs approval of the proposed amendment.

D. Morey As part of the NRC oversight process, the NRC staff may perform one or more inspections to evaluate compliance with the license conditions associated with the license amendment.

The 6th paragraph of Section C.3.2.1.1, Continued Review (Phase 2), was revised as follows:

Consistent with licensing review guidance, the staff should develop a safety evaluation that documents the basis for approval. The safety evaluation should document applicable regulatory requirements; the information provided by the licensee, including regulatory commitments; a summary of the staff evaluation; and the basis for the determination that the application meets applicable regulatory requirements.

The staff and industry then discussed the following inspection workshop details:

1. The workshop will take place at NRC Headquarters (room OWFN-10-B04) on November 15, from 1:00 pm to 5:00 pm.
2. The workshop desired outcome is to reach a common understanding (i.e., provide clarity) on what types of post-license amendment NRC inspections would be performed in relation to an ISG-06 Alternate Review Process license amendment request.
a. Identify the NRC inspection teams and inspection scopes (including the inspection locations)
b. Identify the NRC inspection procedures to be used
3. The inspection workshop will also discuss the Vendor Oversight Plan summary description to be included in the license amendment request.
4. Since ISG-06 does not provide inspection guidance, this workshop is not meant to modify the ISG.
5. The workshop is not meant to modify the NRC inspection guidance/process.
6. The NRC continues to identify staff from the Division of Inspection and Regional Support, Vendor Inspection, and Regional Inspection groups to participate in the workshop.

The following workshop agenda was proposed:

c. NEI Presentation: Industry Perspective (30 mins)
d. NRC Presentation: General Roles and Responsibilities (DIRS, Regional Inspections, Vendor Inspections) (45 mins)

The staff and industry members agreed to prepare and share the draft material for the workshop by October 26, 2018. Another workshop planning call will be held on November 6, 2018, to continue preparing for the workshop.
