This preliminary notification constitutes EARLY notice of events of POSSIBLE safety or public interest significance. The information is as initially received without verification or evaluation, and is basically all that is known by the Region IV, Arlington, Texas, staff on this date.

SUBJECT:

CONTRACT FIRE WATCH EMPLOYEE TERMINATED FOR USE OF A PROHIBITED SUBSTANCE IN THE SITE PROTECTED AREA DESCRIPTION:

On March 11, 2009, the licensee notified the NRC that a non-supervisory, fire watch, contract employee tested positive for an illicit drug. This individual was tested 'for cause' when he was observed smoking what appeared to be marijuana within the licensee's protected area. Upon discovery, the individual's access to the plant was suspended.

The licensee contacted the Federal Bureau of Investigations because the event occurred on federal property and the licensee initiated an investigation into this matter. They are also reviewing past work activities of the individual. The NRC resident inspectors are monitoring licensee actions associated with this event and the regional office is planning an on-site inspection.

The State of California has been notified of this event.
