CLOSURE OF INVESTIGATION (OI 4-2006-026)

Dear Mr. Levine:

This refers to an investigation conducted by the NRC Office of Investigations (OI) regardingactivities at the Palo Verde Nuclear Generating Station. OI initiated the investigation to determine whether licensed reactor operators willfully violated procedural requirements and the associated functional release restrictions for Flow Element 3JSIBFE0348.Based on the evidence developed during the investigation, testimony, and document reviews,the allegation was not substantiated. The NRC plans no further action and considers this investigation closed.In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will beavailable electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
