ST. LUCIE NUCLEAR PLANT: ALLEGED FAILURE TO REPORT AN ARRESTBY A FLORIDA POWER AND LIGHT (FP&L) CONTRACTOR AT ST. LUCIE NUCLEAR PLANT (OFFICE OF INVESTIGATIONS CASE NUMBER 2-2007-006)

Dear Mr. Stall:

Enclosed for your information is the synopsis of the Nuclear Regulatory Commission (NRC)Office of Investigations (OI) completed report regarding alleged failure to report an arrest by a contractor at the St. Lucie Nuclear Plant. OI substantiated that a former contractor at FP&L willfully failed to report an arrest to FP&L, inviolation of licensee procedures. Because it was concluded that FP&L did not violate procedures and had no knowledge of the arrest before it was reported, no enforcement action is being taken against FP&L. However, it was noted during OI interviews that a number of employees with unescorted access at the St. Lucie Nuclear Plant, indicated that they too were unaware of a requirement to report an arrest to FP&L. It is a fundamental tenet of the Access Authorization program that badged employees understand and adhere to these requirements.

The NRC will follow-up on this issue as part of the security baseline inspection. With this exception, we plan no further action with regard to this matter.
