UnitedStatesNuclearRegulatoryCommissionOfficeofPublicAffairsWashington,DC20555Phone301-415-8200Fax301-415-2234 Internet:opa@nrc.govNo.96-122FORIMMEDIATERELEASE(Monday,September16,1996)NRCISSUESINITIALCERTIFICATIONDECISIONFORURANIUMENRICHMENTPLANTSTheNuclearRegulatoryCommissionstaffhasissueditsinitialcertificationdecisiontotheU.S.EnrichmentCorporation (USEC)foruraniumenrichmentplantslocatednearPaducah, Kentucky,andPiketon,Ohio.USEC,orcertainpersonswhoseinterestmaybeaffected,mayfileapetitionrequestingCommissionreviewoftheinitial decisiontoissueacertificate.Thispetitionmustbefiled within15daysafteranoticeofthepreliminarydecisionis publishedintheFederalRegister(expectedaboutSeptember19).Ifnopetitionsarereceived,theDirector,NRCOfficeofNuclearMaterialSafetyandSafeguards,willsignandissuethe certificates.Ifchallengingpetitionsarereceived,the Commissionwillreviewthemanddeterminewhatactiontotake.Thetwoenrichmentplantsareowned,andwereformerlyoperated,bytheDepartmentofEnergy.USECnowoperatesthem underaleasefromDOE.Theplantsuseagaseousdiffusion processtoenrichuraniumhexafluoridegasintheuranium-235 isotope,sothatthematerialcanbeusedasnuclearfuelin civiliannuclearpowerplants.TheEnergyPolicyActof1992,whichestablishedUSEC,alsorequiredtheNRCtoestablishacertificationprocessand standardsfortheplants.NRCistocertifythefacilities periodicallyforcompliancewiththestandards,whichinclude procedural,radiologicalhealth,safety,safeguards,andsecurity requirements.Thisistheinitialcertification.NRChasreviewedUSEC'sapplicationforcertificationandadditionalinformationsubmitted,inresponsetoNRCquestions, aswellaspubliccommentsreceived.Itconcludedthatthereis reasonableassurancethatcontinuedoperationoftheplantswill notconstituteanunduerisktopublichealthandsafety,the environment,andthecommondefenseandsecurity,andthatthe applicationmeetsNRCrequirements.Afteratransitionperiodfollowingissuanceofthe certificates,regulatoryauthorityoverplantoperationswouldbetransferredfromDOEtotheNRConMarch3,1997,unlessthe Commissiondirectsotherwiseafterreviewinganypetitionsfiled.

ThecertificateswillbeeffectiveuntilDecember31,1998.USEC mustapplyforcertificaterenewalbyApril15,1998.
