Dear Mr. Baum:
We are in receipt of your September 26, 2016 letter seeking consultation with the Maine FieldOffice, U. S. Fish and Wildlife Service concerning the Yankee Atomic Electric Companydecommissioning funding plan (DFP). We attempted to use the NRC ADAMS system toaccess the plan, but were unable to do so.If, as described in your letter, the DFP solely describes funding and does not authorize orresult in changes to operations or maintenance activities or changes in effluents or creation ofsolid waste, and furthermore does not authorize any construction, facility modification, or anyother land-disturbing activity or decontamination or decommissioning activity, then theNuclear Regulatory Commission (NRC) is correct in its determination that the proposedfederal action (the funding plan) will not affect listed species or critical habitats.If and when any of these activities (other than funding) are planned, then it would beappropriate for the NRC to consult with the U. S. Fish and Wildlife Service (USFWS) if listedspecies are present. The Maine Field Office, USFWS, website should consulted to develop alist of species that may be present within the action area of planned decommissioningactivities.
