SUBJECT:

UNIVERSITY OF MARYLAND-CLOSURE OF CONFIRMATORY ACTION LETTER NO. NRR-04-004 ON THE SITE-SPECIFIC COMPENSATORY MEASURES IMPLEMENTATION PLAN FOR THE MARYLAND UNIVERSITY TRAINING REACTOR

Dear Dr. Koeth:

The purpose of this letter is to inform you that the U.S. Nuclear Regulatory Commission (NRC) has closed Confirmatory Action Letter (CAL) No. NRR-04-004. The NRC issued CAL No. NRR-04-004 on March 2, 2004 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML033090502). This confirmatory action letter formalized commitments to implement site-specific compensatory measures related to security and safeguards.

By letter dated May 12, 2000, the NRC received an application for license renewal of Facility Operating License No. R-70 for the University of Maryland-Maryland University Training Reactor (MUTR) (ADAMS Accession No. ML052910399). As part of the license renewal application review, the NRC staff reviewed the MUTR physical security plan, dated February 10, 2016, and found it to be in compliance with the applicable regulations contained in Title 10 of the Code of Federal Regulations (10 CFR) Part 73, "Physical Protection of Plants and Materials." In addition, the NRC staff found that the site-specific compensatory measures committed to in CAL No. NRR-04-004 have also been incorporated into the MUTR physical security plan. Therefore, the NRC considers CAL No. NRR-04-004 closed. Under 10 CFR 2.390, "Public inspections, exemptions, requests for withholding," the NRC will make a copy of this letter available electronically for public inspection in the NRC Public Document Room located at NRC Headquarters in Rockville, MD. The public can also access this letter in the NRC's document system, ADAMS, which is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.

T. Koeth If you have any questions, please contact Mr. Anthony Mendiola, Chief of the Research and Test Reactors Oversight Branch, by phone at 301-415-1054 or by electronic mail at Anthony.Mendiola@nrc.gov. Sincerely, /RA/ Michele G. Evans, Deputy Director for Reactor Safety Programs and Mission Support Office of Nuclear Reactor Regulation
