The Instant Motion is a Petition for Reconsideration Thus, the instant Motion is, in effect, a petition for reconsideration of the Board's Order of February 29, 1980, the sole foundation for which is Intervenor's indisposition created by a dog bite on that same date. It should be noted that the indisposition in question did not occur until nine days after expiration of the discovery period. Mr. Doherty does not explain why the instant request for admissions was not a part of his initial request of February 8, 1980 for an extension of the discovery period nor why the request for admissions was not forthcoming prior to the date of his indisposition.
