(Allens Creek Nuclear Generating S Station, Unit 1) S APPLICANT'S RESPONSE TO DOHERTY MOTION RE REQUEST FOR ADMISSIONS I. Introduction On March 19, 1980, Applicant received a document entitled " John F. Doherty's Motion to Permit One Set .f Request for Admissions from Applicant for his Contentions 20, 25, 26, 30, 31, 40, 41, 43, and 44." The period for discovery having expired with respect to the subject conten-tions, the Motion is, in effect, a plea to extend the appli-cable discovery period to accomodate a further request for admissions. For reasons previously expressed by this Board, the Motion should be denied.

II. Prior Pleadings ,

Disposition of the instant Motion requires a brief description of prior, relevant pleadings. On February 8, 1980, Mr. Doherty moved this Board for an order "to extend l

discovery beyond the 120 day limit set on October 19, 1979."

The Board, adopting, in part, reasoning advanced by Staff and Applicant, determined that Intervenor had not established good cause for an extension of the discovery period. (Order, February 29, 1980).

III. The Instant Motion is a Petition for Reconsideration Thus, the instant Motion is, in effect, a petition for reconsideration of the Board's Order of February 29, 1980, the sole foundation for which is Intervenor's indisposition created by a dog bite on that same date. It should be noted that the indisposition in question did not occur until nine days after expiration of the discovery period. Mr. Doherty does not explain why the instant request for admissions was not a part of his initial request of February 8, 1980 for an extension of the discovery period nor why the request for admissions was not forthcoming prior to the date of his indisposition.

IV. No Good Cause Has Been Established Intervenor's sole explanation for this belated motion is that he did not file timely requests for admissions because he "had scheduled insufficient time." In short, the argument is not that the 120 day discovery period was in-adequate but that the time was not properly apportioned or used. 'This confessed lack of diligence shculd be determinative l

any such motion would impair the discipline which this Board has attempted to apply in this case and which is essential if this complex proceeding is to be brought to hearing in a timely manner. i VII. Conclusion For the foregoing reasons, Applicant urges that the subject motion be denied.
