UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON. D.C. 20555-0001 March 24, 2008 SECRETARY MEMORANDUM TO: E. Roy Hawkens Chief Administrative Judge Safety and Licensing Board Panel FROM:
Acting Secretary
SUBJECT:
REQUEST FOR H&ING SUBMITTED BY THE CONNECTICUT COAI-ITION AGAINST MILLSTONE AND NANCY BURTON Attached for your consideration is an e-mail from the Connecticut Coalition Against Millstone (CCAM) and Nancy Burton transmitting a request for hearing and petition to intervene. The petition was submitted in response to a notice of opportunity for hearing with respect to a proposed license amendment that would allow an increase in the authorized power level for the Millstone Nuclear Power Station (Docket No. 50-423).
The notice was issued by the NRC staff and published in the Federal Register at 73 Fed.
Reg. 2549 (January 15,2008).
Submitted with the petition was a request for an exemption from the e-filing submission requirements for reasons explained in the request. CCAM and Ms. Burton were allowed an exception this time to meet the filing deadline. However, the Office of the Secretary was assured by Ms. Burton on behalf of CCAM and herself that the exception to the e-filing rules would only be for this one time. E-filing personnel are working with Ms.
Burton to resolve technical concerns that prohibited her initial filing via the e-filing system.
The Office of the Secretary has entered the petition of CCAM and the exemption request in ADAMS. The accession numbers are respectively ML080840527 and ML080840572.
The ADAMS copies were created from the paper copies submitted. Although this memorandum is being sent by e-mail to representatives of the licensee, the NRC staff and CCAMIMs. Burton, once the Office of the Secretary is assured that all participants can receive it as an e-filing; it will be served via the e-filing system.
The request for hearing is being referred to you for appropriate action in accordance with 10 C.F.R. 2.346(i).
