ORDER This matter is before the Commission on (1) a petition for leave to intervene in the Millstone License Renewal proceeding, see 69 Fed. Reg. 11897 (March 12, 2004), and (2) a Motion to Vacate a determination by the Secretary that a previously-filed petition for leave to intervene in the proceeding was premature. Both the new petition for leave to intervene and the motion to vacate were submitted electronically on March 22, 2004, by the Connecticut Coalition Against Millstone. Pursuant to 10 C.F.R. §2.308, the petition for leave to intervene is referred to the Atomic Safety and Licensing Board Panel for appropriate action. The Commission will retain jurisdiction over the Motion to Vacate. Pursuant to 10 C.F.R. §2.346(a), the NRC Staff and Dominion Nuclear Connecticut, the licensee, may respond to the Motion to Vacate by c.o.b.

Friday, April 2, 2004.
