U. S. NRC to C.M. Crane, "Confirmatory Order Modifying License (Effectively Immediate), Reclassification of Severity Level, and Reduction of Civil Penalty (NRC Office of Investigations Report No. 3-2004-009)" dated November 22, 2005 The purpose of this letter is to request that the NRC rescind the Confirmatory Order modifying the operating licenses for LaSalle County Station (LSCS), Units 1 and 2 that was issued in the referenced letter. The referenced letter transmitted to Exelon Generation Company, LLC (EGC) Confirmatory Order (EA-04-170) that documented specific commitments made by EGC as part of a settlement agreement between EGC and the NRC concerning an apparent violation involving three Venture employees, contractors to EGC, and their foreman, also a Venture employee. The apparent violation involved the access of the contractors to a high radiation area at LSCS on January 24, 2004.
The Confirmatory Order detailed actions to be taken by LSCS in preparation for and during the subsequent two refueling outages (L1 R1 1 and L2R1 1). These actions have been completed and reviewed by the NRC. The results of these reviews are documented in NRC Inspection Reports 05000373(374)/2006003 and 05000373(374)2007002.
The basis for the request to rescind the Order is the successful completion of the actions required by the Order for the specified two refueling outages.
