Dear Mr. Baum:
We are in receipt of your September 26, 2016 letter seeking consultation with the Maine Field Office, U. S. Fish and Wildlife Service concerning the Yankee Atomic Electric Company decommissioning funding plan (DFP). We attempted to use the NRC ADAMS system to access the plan, but were unable to do so.
If, as described in your letter, the DFP solely describes funding and does not authorize or result in changes to operations or maintenance activities or changes in effluents or creation of solid waste, and furthermore does not authorize any construction, facility modification, or any other land-disturbing activity or decontamination or decommissioning activity, then the Nuclear Regulatory Commission (NRC) is correct in its determination that the proposed federal action (the funding plan) will not affect listed species or critical habitats.
