By letter dated August 5,2011 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML 11221A280), as supplemented by letters dated October 14,2011, April 23, 2012, May 23, 2012, July 9, 2012, October 15, 2012, January 11, 2013 , February 12 , 2013, March 6, 2013, May 1, 2013, May 29, 2013, and July 2 , 2013, NextEra Energy Duane Arnold, LLC submitted an application for a license amendment to transition the Duane Arnold Energy Center (DAEC) fire protection program from Title 10 of the Code of Federal Regulations (10 CFR), Section 50.48(b), to 10 CFR 50.48(c), National Fire Protection Association Standard (NFPA) 805, "Performance-Based Standard for Fire Protection For Light Water Reactor Electric Generating Plants," 2001 Edition. The proposed amendment would transition the DAEC fire protection program to a performance-based, risk-informed program based on NFPA 805, in accordance with 10 CFR 50.48(c).

NFPA 805 allows the use of performance-based methods such as fire modeling and risk-informed methods such as fire probabilistic risk assessment to demonstrate compliance with the nuclear safety performance criteria.
The proposed amendment would transition the DAEC fire protection program to a performance-based, risk-informed program based on NFPA 805, in accordance with 10 CFR 50.48(c). NFPA 805 allows the use of performance-based methods such as fire modeling and risk-informed methods such as fire probabilistic risk assessment to demonstrate compliance with the nuclear safety performance criteria.
The U.S. Nuclear Regulatory Commission (NRC) staff is nearing completion of its review of the DAEC license amendment request to transition to NFPA 805. However, during the course of the staff's evaluation of this request, subsequent conversations with members of the DAEC staff, and incorporation of lessons learned during the NFPA 805 pilot process into the associated guidance documents, several clarifying changes have been made to the proposed license condition provided in the original submittal.
The U.S. Nuclear Regulatory Commission (NRC) staff is nearing completion of its review of the DAEC license amendment request to transition to NFPA 805. (2) The licensee shall implement the modifications to its facility, as described in Enclosure 2, Attachment S, Table S-1, "Plant Modifications Committed," of DAEC letter NG-13-0287, dated July 2,2013, to complete the transition to full compliance with 10 CFR 50.48(c) by December 31,2014. The licensee shall maintain appropriate compensatory measures in place until completion of these modifications.
(3) The licensee shall implement the items listed in Enclosure 2, Attachment S, Table S-2 , "Implementation Items," of DAEC letter NG-13-0287, dated July 2, 2013, by              ,2014.
