OF OCTOBER 23, 2018, PARTIALLY CLOSED MEETING WITH HOLTEC INTERNATIONAL TO DISCUSS HOLTECS MAY 24, AND JULY 27, 2018, RESPONSES TO NRC STAFFS MARCH 28, 2018, REQUESTS FOR ADDITIONAL INFORMATION FOR THE REVIEW OF THE LICENSE APPLICATION FOR THE PROPOSED HI-STORE CONSOLIDATED INTERIM STORAGE FACILITY AT LEA COUNTY, NEW MEXICO On October 23, 2018, staff from the Division of Spent Fuel Management held a partially closed meeting with representatives from Holtec International (Holtec), at the U.S. Nuclear Regulatory Commission (NRC) Headquarters in Rockville, Maryland. The purpose of the meeting was to discuss Holtecs May 24 and July 27, 2018, responses to NRC staffs request for additional information (RAI), issued on March 28, 2018, in connection with its review of the license application for the HI-STORE Consolidated Interim Storage (CIS) Facility. NRC staff requested the meeting to discuss issues identified in Holtecs supplemental responses to the staffs RAI related to aircraft hazards (dated July 27, 2018), and issues identified in their responses to the staffs RAI related to the soil stability assessment (dated May 24, 2018) for the proposed HI-STORE CIS facility. No regulatory decisions were made nor requested at this meeting.
During the first part of the meeting, NRC staff made a presentation (ADAMS Accession No ML18295A169) discussing the specific issues identified in Holtecs July 27, 2018 supplemental response to RAI 2-1 (issued by NRC staff on March 28, 2018). In its March 28, 2018, RAI, NRC staff requested that Holtec provide an assessment of any potential aircraft hazards at the proposed site. Holtec submitted its responses to the RAI on May 24, 2018. The NRC identified several issues with Holtecs response, which NRC staff identified and discussed with Holtec in a public meeting held on June 19, 2018 (ADAMS Accession No. ML18200A106). During the October 23 meeting, NRC staff provided a detailed discussion of the remaining issues with the July 27 response and provided additional guidance to Holtec for addressing these in a revised response. NRC staff also requested that Holtec notify NRC staff prior to the submission of supplemental information and offered to conduct a pre-submission audit or another public meeting to discuss that revised responses prior to submission.
During the closed portion of the meeting, NRC staff held a discussion of Holtecs responses to RAI 2-2 (issued by NRC staff on March 28, 2018), which contained proprietary information. In its March 28, 2018, RAI, NRC staff requested that Holtec provide an assessment of the soil stability properties at the proposed site. Holtec submitted its responses to the RAI on May 24, 2018. Prior to the closed discussion, NRC staff provided a public overview of the issues identified in Holtecs RAI 2-2 response (ADAMS Accession No. ML18295A170). During the closed portion of the meeting, NRC staff identified the issues it found with Holtecs geotechnical stability assessment provided in its RAI response and answered clarification questions from Holtec for addressing these. Holtec stated that it would review the information provided and notify NRC staff of a proposed response schedule at a future date. Following the meeting, Holtec confirmed that the detailed slides used during the closed portion of the meeting did not contain proprietary information and could be publicly released. Accordingly, the slides for the closed portion are enclosed.
Before adjourning, NRC staff reminded Holtec that a timely completion of NRCs safety review requires timely and high-quality responses to the NRC staffs questions and emphasized the importance of early engagement and communication with NRC staff in its preparation of RAI responses.
After the open portion of the meeting, several members of the public participating by phone asked questions and provided comments to NRC staff. The questions made by the public sought clarification regarding the scope of the aircraft hazards assessment and the types of military aircraft to be considered in the assessment.
