ST. LUCIE NUCLEAR PLANT - DISCRIMINATION AGAINST A FORMER INSTRUMENT AND CONTROL TECHNICIAN/TRAINER FOR REPORTING SAFETY CONCERNS (OI REPORT NO. 2-2008-040)

Dear Mr. Nazar:

Enclosed for your information is the synopsis of the completed investigative report of the Nuclear Regulatory Commission's (NRC) Office of Investigations (OI). The report documented the results of OI's review of the facts and circumstances associated with alleged discrimination against an Instrument and Control technician for reporting safety concerns.

OI found that there was insufficient evidence to substantiate a finding of discrimination. We plan no further action in this matter. Should you have any questions concerning this letter, please contact us.

In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter and its enclosure will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS). Investigative Synopsis OI Report No. 2-2008-040

SYNOPSIS This investigation was initiated on May 5, 2008, by the U.S. Nuclear Regulatory Commission (NRC), Office of Investigations (OI), Region II (RII), to determine whether a former Instrument and Control (I&C) Technician/Trainer at the St. Lucie Nuclear Power Plant (SLNP) was discriminated against for raising safety concerns.

Based on the evidence developed during this investigation, OI:RII did not substantiate that the former I&C Technician/Trainer was discriminated against for raising safety concerns.
