Dear Mr. Rausch:

The Region I Field Office, NRC Office of Investigations (OI), initiated an investigation (Case No. 1-2010-048) on July 20, 2010, to determine whether a licensed operator at the Susquehanna Steam Electric Station (SSES) was discriminated against for having raised safety concerns. Based on testimonial and documentary evidence, the NRC was unable to substantiate that the operator was subject to discriminatory acts for having raised safety concerns. Rather, the NRC concluded that licensee management did not act in a discriminatory manner against the operator. Specifically, the actions taken against the operator were intended to improve the operator's performance to effectively communicate with crew members, and were not related to any involvement in raising safety concerns.

Please note that final NRC investigation documents, such as the OI report described above, may be made available to the public under the Freedom of Information Act (FOIA) subject to redaction of information appropriate under the FOIA. Requests under the FOIA should be made in accordance with 10 CFR 9.23, "Requests for Records," a copy of which is enclosed for your information.
