ENERGY 40 CFR266 Docket No. 50-387 50-388 In accordance with 40 CFR 266.240(a)(l), this letter serves as notice of missed annual inventories of conditionally exempt low-level mixed waste (LLMW), required by 40 CFR 266.230(b)(4), at the Susquehanna Steam Electric Station (SSES).

Susquehanna Nuclear, LLC (Susquehanna), submitted notification to the Pennsylvania Department of Environmental Protection (PaDEP) claiming LLMW conditional exemption per 40 CFR 266, Subpart N (incorporated by reference at 25 Pa. Code 266a.20) on July 13, 2009, under PLE 0024767. The exemption is conditional and based on continued compliance with 40 CFR 226.230.

Contrary to the requirements of 40 CFR 266.230(b)(4), Susquehanna did not conduct annual inventories since June 14, 2021. The absence of inventory records was discovered during an internal compliance review conducted on September 19, 2024.

This issue has been documented in the SSES corrective action program. This notification satisfies the 30-day report requirements in 40 CFR 266.240(a)(l), subparts (i) and (iii). A supplemental report to provide the information required by 40 CFR 266.240(a)(l)(ii) will be

  • submitted following completion of the required inventory. Additional actions to be taken include updating procedures and tasks to ensure that inventories are conducted annually.

Page 2 Division of Hazardous Waste Management PLE 0026645 It is essential to emphasize that non-compliance with the stipulation outlined in 40 CFR 266.230(b)(4) did not endanger plant personnel nor lead to any environmental discharge.

This letter contains no new or revised regulatory commitments.
