The team identified a non-cited violation The team identified a non-cited violation of 10 CFR Part 50, Appendix B, Criterion V, Instructions, Procedures and Drawings, involving multiple examples of the licensees failure to perform an adequate operability determination as required by Procedure NOD-QP-31, Operability Determination Process. In each example, the team identified that the operability determination lacked adequate technical justification for why the structure, system, or component was operable with the degraded or nonconforming condition. Specifically, on January 24, 2012, June 6, 2012, December 27, 2012, January 22, 2013, and February 5, 2013, the operability determinations for Condition Reports CR 2012-00580, CR 2012-04973, CR 2012-20806, CR 2013-00907, and CR 2013-02260 were not performed in accordance with Procedure NOD-QP-31, Revision 49-53, Step 4.1.3 J. This issue has been entered into the corrective action program as Condition Reports CR 2013-08343, CR 2013-05596, CR 2013-08590, CR 2013-04163, and CR 2013-05353. This performance deficiency is more than minor, and therefore a finding, because it is associated with the equipment performance attribute of the Mitigating Systems Cornerstone, and affected the cornerstone objective to ensure the availability, reliability, and capability of systems that respond to initiating events to prevent undesirable consequences. Since the finding involving inadequate operability determinations occurred while in a shutdown condition, the team used Manual Chapter 0609, Appendix G, Shutdown Operations Significance Determination Process, and determined the finding to have very low safety significance (Green) because the finding did not increase the likelihood of a loss of reactor coolant system inventory, the finding did not degrade the licensees ability to terminate a leak path or add reactor coolant system inventory when needed, and the finding did not degrade the licensees ability to recover decay heat removal once it was lost. This finding has a cross-cutting aspect in the area of problem identification and resolution associated with corrective action program component. Specifically, the team identified that the licensee failed provide an adequate technical discussion such that a reasonable expectation of operability was demonstrated for several degraded or nonconforming conditionsveral degraded or nonconforming conditions
