These are required by The Nuclear Regulatory Commission in January immediately following the year in question. These should include, but not be limited to, reports submitted by International Isotopes and Gunther Melles (or its successors). Under the Freedom of Information Act, I am requesting copies of any training materials presented to employees, managers or leadership on the topic of diversity, equity, inclusion and accessibility.
Please begin the search on Jan. 1, 2022 and end the search on the date that the request is fulfilled. Please include trainings regardless of whether they preexisted President Biden's executive order mentioned above. To the extent that participation in such trainings is statistically tracked, please provide that data as well. I am also requesting any vendor contracts, agreements or proposals related to the creation and/or presentation of those training materials. Please consider waiving fees, since the information is being sought in the public interest by a media organization. If there are fees for this request, please advise before it is fulfilled. Items of Interest Week Ending January 13, 2023 NuScale Completed Submittal of Their Standard Design Approval On January 8, 2023, NuScale completed submittal of their Standard Design Approval Application (SDAA) and supplemental reports to support the review of their US460 plant design.
By letter dated November 21, 2022 (Agencywide Documents Access and Management System Accession Number ML22325A349), NuScale has been submitting parts of their SDAA to the U.S. Nuclear Regulatory Commission (NRC) as part of a staged submittal format for their application which has culminated in all parts of the NuScale SDAA application being submitted including all chapters and technical/topical reports. As communicated to NuScale via the staffs May 11, 2022, letter (ML22124A209), acceptance of the SDAA application is contingent on the staffs review and acceptance of all applicable chapters and topical reports. The staff began its 60-day acceptance review on January 9.
Susquehanna Submits Emergency License Amendment Request On January 10, 2023, Susquehanna Nuclear, LLC (the licensee) submitted an emergency license amendment request (LAR) to modify Susquehanna Unit 2 technical specifications (TS) and requested NRCs review be completed by Sunday, January 15, 2023 (ML23010A265). This is due to control cell friction issues where the licensee does not expect to be able to withdraw control rods in a manner that complies with their withdrawal sequence and support entry into Mode 1 following a maintenance outage. Therefore, the licensee is requesting this temporary license amendment to allow for an alternate rod withdrawal sequence. On January 12, the NRR and Region 1 staff held an audit call with the licensee and a call with officials from the Commonwealth of Pennsylvania, Department of Environmental Protection to discuss the LAR.
NRC Held Pre-Submittal Public Meeting on Digital Modernization Project License Amendment Request On January 10, 2023, NRC staff and representatives of Constellation held a pre-submittal public meeting concerning the planned Limerick digital modernization project installation support license amendment request and exemption request. To complete the digital modification at Limerick within its planned outage, Constellation plans to start demolition of some of the affected plant equipment prior to the start of the outage. The changes that Constellation plans to request are described in its presentation (ML23006A257). The NRC staff provided several recommendations concerning the proposed content of the planned LAR and exemption request to ensure their completeness and clarity. Constellation plans to submit the requests by January 31, 2023. These requests are separate from the Limerick digital instrumentation and controls LAR that focuses on the digital upgrade, whereas these planned requests focus on installation of the digital upgrade.
NRC Hosts Public Meeting Regarding Vogtle Unit 3 Emergency Amendment On January 11, 2023, NRR hosted a public pre-submittal meeting for a proposed emergency LAR for Vogtle Unit 3 (ML23011A321). The proposed LAR seeks to change the Vogtle TS to allow repairs to address vibrations found in Unit 3 Automatic Depressurization System piping while in Mode 4. Subsequent to the meeting, Southern Nuclear Company submitted the request on January 12, 2023 (ML23012A238). The NRC staff approved the request on January 13, 2023 (ML23013A214). Georgia Power announced that the repairs will likely delay commercial operations from March to April 2023. The pre-submittal meeting was attended by several members of the public, including Dr. Edward Lyman from the Union of Concerned Scientists.
The issue also appeared in news reports from the Associated Press.

NRC Staff Attends Configuration Risk Management Forum and Human Reliability Analysis User Group Meeting On January 9-12, 2023, NRC staff attended the Electric Power Research Institute Configuration Risk Management Forum and Human Reliability Analysis (HRA) Users Group meeting at EPRIs headquarter in Charlotte, NC. Staff presented on various topics related to probabilistic risk assessment configuration control, SAPHIRE models, SPAR-DASH, and IDHEAS HRA dependency methodology (ML23010A232). The meeting was well attended and covered several technical topics related to risk assessment methodology, risk assessment tools, and human reliability analysis methods and tools.

Items of Interest Week Ending January 13, 2023 NRC Issued an Exemption from the 100 Meters Regulatory Requirements in 10 CFR 72.106(b), in Response to a December 16, 2021, Request from Southern California Edison.
On January 5, 2023, the U.S. Nuclear Regulatory Commission (NRC) issued an exemption, from the 100 meters regulatory requirement identified in Title 10 of the Code of Federal Regulations 72.106(b), in response to a December 16, 2021, request from Southern California Edison (SCE) (ML21355A245). The exemption will allow the licensee to establish a controlled area boundary (CAB) for the San Onofre Nuclear Generating Station independent spent fuel storage installation (ISFSI) at a distance of less than 100 meters. The exemption is effective immediately, but SCE plans on reducing its ISFSI CAB after its greater-than-class C transfer campaign scheduled to be completed sometime in March 2023.
NRC Issued Renewed Part 70 Special Nuclear Material License to Idaho State University for an Additional 10 years.
On January 6, 2023, the NRC staff issued a renewed Part 70 special nuclear material (SNM) license (SNM-1373) to Idaho State University (ISU) for an additional 10 years, to January 5, 2033 (ML22147A068). The license will allow continued possession and use of fuel plates and associated material that contain greater than critical mass amounts of SNM. A notice of availability of the renewed license and associated safety evaluation was published in the Federal Register on January 11, 2023. ISU is located in Pocatello, Idaho.
Rescheduled Public Meetings for the Comanche Peak Nuclear Power Plant License Renewal Review Due to a Change in the Local COVID Transmission Rate to High.
On January 6, 2023, staff canceled in-person Environmental Impact Statement scoping public meetings for the Comanche Peak Nuclear Power Plant license renewal review due to a change in the local COVID transmission rate to High. The environmental scoping meetings, originally planned for January 10th in Texas, have been rescheduled as one virtual public meeting on January 17th, from 2:00 PM to 4:00 PM ET. The meeting information is being updated on the NRCs public website and stakeholders and registered individuals have been notified of the changes by the Office of Congressional Affairs, the Regional State Liaison Officer, the Office of Public Affairs, and the Comanche Peak Project Managers. Additionally, the planned site tour, to include Congressional staffers, has been postponed.
Adjustment of Civil Penalties for Inflation for Fiscal Year 2023: Final Rule; 10 CFR Parts 2 and 13 [NRC-2021-0025; RIN 3150-AK59].
On January 13, 2023, the NRC published a final rule in the Federal Register (88 FR 2188) amending its regulations to adjust the maximum civil monetary penalties it can assess under statutes enforced by the agency. These changes are mandated by the Federal Civil Penalties Inflation Adjustment Act of 1990, as amended by the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015. The NRC is amending its regulations to adjust the maximum civil monetary penalty for a violation of the Atomic Energy Act of 1954, as amended, or any regulation or order issued under the Atomic Energy Act, from $326,163 to $351,424 per violation, per day. Additionally, the NRC is amending provisions concerning program fraud civil penalties by adjusting the maximum civil monetary penalty under the Program Fraud Civil Remedies Act from $12,537 to $13,508 for each false claim or statement. The final rule is effective January 13, 2023.

Revision of the NRC Enforcement Policy Statement: Revision to Policy Statement; 10 CFR Part 2 (NRC-2022-0205).
On January 13, 2023, the NRC published a notice in the Federal Register (88 FR 2187) issuing a revision to its Enforcement Policy. This revision addresses the requirements of the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015, which requires Federal agencies to adjust their maximum civil monetary penalty amounts annually for inflation. This action is effective on January 13, 2023.
