Items of Interest Week Ending July 29, 2022 NRC Receives All ITAAC Complete letter for Vogtle Unit 3 On July 29, 2022, Southern Nuclear Operating Company (SNC) submitted the All ITAAC Complete letter for Vogtle Unit 3. This letter informs the U.S. Nuclear Regulatory Commission (NRC) that all of the inspections, tests, analyses, and acceptance criteria (ITAAC) in the Vogtle Unit 3 combined license are complete. The staff is completing inspections and ITAAC verifications to independently determine that all of the acceptance criteria have been met. If the staff determines that all the acceptance criteria are met, it plans to issue a memorandum to the Commission documenting the basis for this determination during the week of August 1, but no later than August 12. Three calendar days following issuance of this Commission memorandum, the staff would make the Title 10 of the Code of Federal Regulations 52.103(g) finding. The finding will allow SNC to load fuel and begin operation of Vogtle Unit 3 in accordance with the terms and conditions of the license.
NRC Issues Closeout Letter for Bulletin 2012-01 to Monticello On July 29, 2022, the NRC staff issued a closeout letter (Agencywide Documents Access and Management System (ADAMS) Accession No. ML22189A019), for Bulletin 2012-01, Design Vulnerability in Electric Power System, (ADAMS Accession No. ML12074A115), for Monticello Nuclear Generating Plant (Monticello). The staff has reviewed the information submitted by Northern States Power Company (the licensee) and the results of NRCs Temporary Instruction 2515/194, Inspection of the Licensees Implementation of Industry Initiative Associated with the Open Phase Condition Design Vulnerabilities in Electric Power Systems (NRC Bulletin 2012-
- 01) inspections for Monticello in reaching the closeout conclusion.
NRC Resumes In-Person ROP Bi-Monthly Meetings On July 27, 2022, the NRC staff hosted the first in-person Reactor Oversight Process (ROP) bi-monthly meeting, using a hybrid format, since the advent of the COVID-19 public health emergency. Topics included: NRCs Artificial Intelligence Strategic Plan and Roadmap (ADAMS Accession No. ML22203A085), ROP COVID-19 Lesson Learned Working Group Recommendations (ADAMS Accession No. ML22201A172), Overview of the Change to the VLSSIR Process to Clarify Consideration of Traditional Enforcement Issues (ADAMS Accession No. ML22201A137), Calendar Year 2021 ROP Self-Assessment Program Results (ADAMS Accession No. ML22200A311), status of ROP Enhancement activities, discussion of FAQ 22-02 related to a scram at Diablo Canyon (ADAMS Accession No. ML22206A260) and submission of FAQ-22-03 concerning a scram at the Susquehanna Nuclear Plant (ADAMS Accession No. ML22206A259). Attendees included Nuclear Energy Institute, NextEra, and members of the public. The next ROP bi-monthly public meeting is tentatively scheduled for September 28.

NRC Issues High Energy Arcing Faults (HEAF) LIC-504 Team Recommendations On July 22, 2022, the NRC staff issued a memorandum entitled, High Energy Arcing Faults LIC-504 Team Recommendations. The memo and enclosures were released to the public on July 27, 2022. This memorandum presents the LIC-504 teams detailed analyses and recommendations for managements consideration regarding potential follow-up actions by NRC staff. The staff has concluded that there is no significant increase in total HEAF risk warranting the need for any additional regulatory requirements. The staff identified some scenarios where the risk of HEAF is higher than calculated under the previous methodology, and other scenarios where the risk is lower. In addition, the staff evaluated various communication options that would enable the staff to share its insights with external stakeholders for licensee consideration to implement effective steps to further reduce and/or mitigate HEAF risks. Items of Interest Week Ending July 29, 2022 Access Authorization Fees: Final Rule; 10 CFR Parts 11, 25, and 95 [NRC-2020-0133; RIN 3150-AK49]
On July 28, 2022, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (87 FR 45235) amending its regulations to update the access authorization fees charged to NRC licensees for work performed under the Material Access Authorization Program and the Information Access Authority Program. The change in fees is due to an increase in the review time for each application for access authorization. This final rule is prompted by a recent audit of fees performed by an external certified public accounting and financial management services firm and ensures that the NRC continues to recover the full costs of processing access authorization requests from NRC licensees. The final rule also makes two administrative changes to revise definitions to include new naming conventions for background investigation case types and to specify the electronic process for completing security forms. The final rule is effective October 1, 2022.
List of Approved Spent Fuel Storage Casks: NAC International NAC-UMS Universal Storage System, Certificate of Compliance No. 1015, Amendment No. 9; Direct Final Rule; Confirmation of Effective Date; 10 CFR Part 72 [NRC-2022-0049; RIN 3150-AK76]
On July 28, 2022, the NRC published a notice in the Federal Register (87 FR 45242) confirming the effective date of August 29, 2022, for the direct final rule that was published in the Federal Register on June 14, 2022 (87 FR 35858). This direct final rule amends the NAC International NAC-UMS Universal Storage System listing in the List of approved spent fuel storage casks to include Amendment No. 9 of Certificate of Compliance No. 1015. In addition, this rulemaking makes editorial corrections to Amendment No. 8. The effective date of August 29, 2022, for the direct final rule published June 14, 2022, is confirmed.
List of Approved Spent Fuel Storage Casks: Holtec International HI-STORM Flood/Wind Multipurpose Canister Storage System, Certificate of Compliance No. 1032, Amendment Nos. 8; 10 CFR Part 72; Direct Final Rule [NRC-2022-0105; RIN 3150-AK84]
On July 26, 2022, the NRC published a notice in the Federal Register (87 FR 44273) amending its spent fuel storage regulations by revising the Holtec International HI-STORM Flood/Wind Multipurpose Canister Storage System listing within the List of approved spent fuel storage casks to include Amendment No. 8 to Certificate of Compliance No. 1032. Amendment No. 8 revises the description in the certificate of compliance for the Holtec International HI-STORM Flood/Wind system to clearly indicate that only the portions of the components that contact the pool water need to be made of stainless steel or aluminum. Amendment No. 8 also incorporates other minor editorial corrections. The companion proposed rule was also published in the Federal Register on July 26, 2022 (87 FR 44283). This direct final rule is effective October 11, 2022.

Accident Source Term Methodologies and Corresponding Release Fractions: Petition for Rulemaking; Denial; 10 CFR Part 50; [Docket Nos. PRM-50-122; NRC-2020-0510]
On July 26, 2022, the NRC published a notice in the Federal Register (87 FR 44281) denying a petition for rulemaking dated May 31, 2020, submitted by Brian Magnuson. The petitioner requested that the NRC revise its regulations to codify the source term methodologies and corresponding release fractions recommended in a report issued by Sandia National Laboratories and to codify a modified version of draft regulatory guide DG-1199. The NRC docketed the petition on June 18, 2020, and assigned it Docket No. PRM-50-122. The NRC is denying the petition because the proposed changes would unnecessarily reduce the intended flexibility in the NRC's regulatory approach, and they are not necessary to provide reasonable assurance of adequate protection of public health and safety. The docket for PRM-50-122 is closed on July 26, 2022.
NMSS Staff Attended Meeting on Decommissioning and Water Quality of the Great Lakes On July 27, NMSS staff attended the International Joint Commission Great Lakes Water Quality Board on Nuclear Decommissioning Report Recommendation Feedback By-Invitation Meeting with Regulators and provided comments on the November 2020 International Joint Commission Report by the Great Lakes Water Board, Decommissioning of Nuclear Power Facilities in the Great Lakes Basin. Attendees included eight Canadian national and provincial regulatory agencies, and five US federal and state regulatory agencies.

The purpose of this contract is to procure Grounds Maintenance (Landscape) and Snow and Ice Removal services at NRCs Headquarters facility (One White Flint North and Two White Flint North) located in Rockville, Maryland. The period of performance is from August 1, 2022, through July 31, 2023, with four option periods.
The total potential value of the contract can be up to $1,110,709.76.
