Submission of Standard Practice Procedure Plans and Updated Foreign Ownership Control or Influence Package

Letter from B. W. Stapleton (U. S. NRC) to P. R. Simpson (Exelon Generation Company), dated June 28, 2012 In response to the referenced letter, Exelon Generation Company, LLC (EGC) is submitting an updated Foreign Ownership Control or Influence (FOCI) package, including form SF 328, "Certificate Pertaining to Foreign Interests," for the nuclear power plants listed above. The FOCI package, included in Attachment 1, reflects the current organizational structure and ownership information. In addition, complete Standard Practice Procedure Plans for each of the nuclear plants listed above and the corporate offices in Warrenville, IL, and Kennett Square, PA, have been included, pursuant to 10 CFR 95.19(c).

Portions of Attachment 1 contain Personally Identifiable Information (PII) that, if made public, would constitute a clearly unwarranted invasion of personal privacy. Additionally, Attachment 1 contains information that EGC considers business sensitive information, and Attachment 2 contains sensitive security related information. Accordingly, it is respectfully requested that the information in Attachment 1 be withheld from public disclosure in accordance with 10 CFR 2.390(a)(4) and 10 CFR 2.390(a)(6), and the information in Attachment 2 be withheld from public disclosure in accordance with 10 CFR 2.390(d)(1). Because EGC seeks to withhold these attachments in their entirety, a nonproprietary version of the attachments has not been prepared.

Attachment 3 Affidavit Supporting Request for Withholding

Affidavit in Support of Request to Withhold Information from Public Disclosure Pursuant to 10 CFR 2.390 I, Patrick R. Simpson, Manager - Licensing, state that:

1. I am authorized to execute this affidavit on behalf of Exelon Generation Company, LLC (EGC).
2. EGC is submitting a complete, updated Foreign Ownership, Control, or Influence Package to the Nuclear Regulatory Commission (NRC) for its review and for the purpose of obtaining a renewal of its non-possessing facility clearance (FCL) at the Secret -National security Information Level. This information is submitted pursuant to the NRC's letter dated June 28, 2012, to P. R. Simpson, Manager - Licensing.
3. Portions of the information being submitted in Attachment 1 contain Personally Identifiable Information (PII) that is appropriate to be withheld from public disclosure in accordance with 10 CFR 2.390(a)(6).
4. Other information being submitted in Attachment 1 contain confidential business information and records related to EGC that should be held in confidence by the NRC, pursuant to 10 CFR 9.17(a)(4) and 10 CFR 2.390(a)(4). The following factors, as specified in 10 CFR 2.390(b)(4), justify withholding this information from public disclosure in its entirety:
a. This information is and has been held in confidence by EGC.
b. This information is a type that is held in confidence by EGC, and there is a rational basis for doing so because the information contains sensitive business information related to the business structure of the companies.
c. This information is being transmitted to the NRC in confidence.
d. This information is not available in public sources and could not be gathered readily from other publically available information.
5. In Attachment 2, EGC is submitting a complete Standard Practices Procedure Plan. The Standard Practices Procedure Plan contains sensitive security-related information that should be withheld from public disclosure for the following reasons:
a. The information is previously determined to be security-related information;
b. The information sought to be withheld is being provided to the NRC in confidence, and under the provisions of 10 CFR. 2.390(d)(1), it is to be received in confidence by the NRC; and
c. This information is not readily available in public sources and could not be gathered readily from other publicly available information
6. Accordingly, EGC requests that the designated information be withheld from public disclosure pursuant to 10 CFR 9.17 and 10 CFR 2.390.
