NRC NEWS U.S. NUCLEAR REGULATORY COMMISSION Office of Public Affairs, Region I 475 Allendale Road, King of Prussia, Pa. 19406 www.nrc.gov No. I-03-058 September 30, 2003 CONTACT: Diane Screnci, 610/337-5330 Email: opa1@nrc.gov Neil Sheehan, 610/337-5331 NRC BOARD ISSUES ORDER APPROVING THE SETTLEMENT OF CIVIL PENALTY PROCEEDING INVOLVING AN EASTON, PA., COMPANY A Nuclear Regulatory Commission Atomic Safety and Licensing Board has issued an order approving a settlement agreement between the NRC staff and Advanced Medical Imaging and Nuclear Services of Easton, Pa. The agreement reduces a civil penalty against the company from $43,200 to $27,500.

On February 19, the NRC staff issued an order imposing a civil penalty of $43,200 for deliberate violations of agency requirements. (The penalty had been proposed in October of last year.) Specifically, the company was cited for using byproduct material for medical use without an authorized user; failing to appoint a radiation safety officer; and creating incomplete and inaccurate records.

Advanced Medical Imaging appealed the notice of violation and civil penalty, and requested a hearing. In April, an Atomic Safety and Licensing Board was established to preside over the enforcement proceeding and granted the companys hearing request. After several months of negotiations, the NRC staff and the company reached a settlement.

The company has 30 days to pay the reduced penalty.
