Sheehan (610)337-5331/e-mail: nas@nrc.gov NRC WITHDRAWS CIVIL PENALTIES AGAINST PENNSYLVANIA MAN The Nuclear Regulatory Commission staff has withdrawn civil penalties against a Havertown (Delaware County), Pa., man who had been fined for failing to properly dispose of nuclear gauges in his possession.

Alphonso DeLeo, Jr., was licensed by the NRC to possess and use gauges containing radioactive cesium-137 and americium-241. The license was suspended in February 1996 for non-payment of fees. When NRC inspectors determined Mr. DeLeo still had the gauges in his possession, despite repeated notices from NRC about the need to dispose of them, the agency issued a

$5,500 civil penalty in June 1999. Then, in August of that year, the NRC imposed the earlier fine and proposed a second civil penalty in the amount of $15,000.

On October 23, 2000, Mr. DeLeo transferred the gauges to an authorized recipient. His NRC license was terminated in November.

In light of the termination of the NRC license, the agency has decided to withdraw all civil penalties and considers this matter closed.
