The purpose of this letter is to provide documents requested by the NRC reviewers during the NRC's Environmental Audit conducted at the Susquehanna Steam Electric Station (SSES). The audit was conducted between May 15 and May 17, 2007. NRC reviewers requested PPL provide these documents during the audit de-brief meeting to complete the environmental review of PPL's application for a renewed operating license. Each document request is identified in the enclosure to this letter (as provided by the NRC Environmental Project Manager at the audit de-brief meeting) along with a written response by PPL. In some cases, NRC requests were edited for clarity, as shown in bracketed text. The requested documents are provided as attachments to this letter and are informational in nature to assist the NRC review. Please note that one of the documents is in response to NRC Question #25, identified during the audit de-brief meeting. PPL Response: Based on the recollection of an individual familiar with the site prior to the power plant, the Golomb brothers (Charles and Theodore) operated a truck farm, growing typical vegetables such as beans, potatoes, sweet corn, tomatoes, cabbage, etc. They operated a produce stand alongside Route 11 and sold some of their vegetables from there. Most of the produce was sent to Thomas & Thomas Co. in Wilkes-Barre, PA, for resale to other areas. The individual did not recall any dairy, beef, or poultry animals being raised on the farm. Other adjacent farms like the Woznock's and Naunczek's, portions of which comprise SSES property today, did basically the same.

I I Notice of Appeal Procedure The following procedures are in effect beginning July 1, 2006, pursuant to 2006 Act No. 387:
- 1. This decision of the S.C. Department of Health and Environmental Control (Department) becomes the final agency decision 15 days after notice of the decision has been mailed to the applicant or respondent, unless a written request for final review is filed with the Department b~y, the applicant, permittee, licensee, or affected person.
- 2. An applicant, permittee, licensee, or affected person who wishes to appeal this decision must file a written request for final review with the. Clerk of the Board at the following address or by facsimile at 803-898-3323.

This is in reference to your application, CENAB-OP-RPA (PP&L/SUSQUEHANNA STEAM ELECTRIC STATION)06-10107-P12, dated June 19, 2006 and received by the Corps on June 26, 2006, for Department of the Army (DA) authorization to maintenance dredge approximately 200 cubic yards of silt and sediment from approximately 5,000, square feet in front of the Susquehanna Steamn Electric Station's River intake structure. In addition, 20 to 30 cubic yards shall be removed from inside the discharge diffuser pipe on the river bottom: Dredging will not extend outside the limits of previously permitted maintenance dredging areas. The project is located approximately 0.25 miles east of U.S. Route 11, along the Western bank of the Susquehanna River, in Salem Township, Luzeme County, Pennsylvania. In addition, all dredged material shall be removed to an upland disposal site. Thismaintenance dredging will be conducted on an as needed basis to minimize the accumulation of silt and sediment throughout the station's cooling system. This waterway (and wetlands) has (have) been determined to be within our regulatory jurisdiction and the proposed activity requires DA authorization pursuant to Section 404 of the Clean Water Act and/or Section 10 of the Rivers and Harbors Act of 1899. The proposed work, if accomplished in accordance with the enclosed terms and conditions and the information included in your application, is authorized under the Pennsylvania State Programmatic General Permit-3 (PASPGP-3), as published in the Corps Special Public Notice 06-35 issued on June 12, 2006. This authorization maybe subject to modification, suspension, or revocation if any of the information contained in the application, including the plan(s), is later found to be in error. The enclosed list of conditions must be followed for purposes of the PASPGP-3. The enclosed self-certification form must be completed and returned to this office. This verification is' valid for the length of the Pennsylvania Department of Environmental Protection (PADEP) permit, not to exceed three years, or until the PASPGP-3 is modified, reissued, or revoked. You must remain informed of changes to the PASPGP-3. We will issue a public notice announcing the changes when they occur.
2 Activities authorized under the PASPGP-3 that have commenced construction or are under contract to commence construction, will remain authorized provided the activity is-completed within 12 months of the date of the PASPGP-3's expiration, modification, or revocation; or until the expiration date of the project specific verification, whichever is less. Be advised that this verification authorizes the aforementioned work as a single and complete (one time only) activity. If additional work is to be performed, you must notify this office. Subsequent work in this area may require a separate letter of authorization from this office. This verification does not obviate the need for obtaining other Federal, State, or local authorizations. Aquatic Life Movements: No activity may substantially disrupt the movement of those species of aquatic life indigenous to the waterbody, including those species which normally migrate through the area, unless the activity's primaiy purpose is to impoundwater. Culverts placed in streams must be appropriately depressed to maintain aquatic life movement and low flow conditions.
- 3. Threatened and Endangered Species: If an activity is authorized under the PASPGP-3, and a Federally listed threatened or endangered species, or proposed species or critical habitat, is subsequently found to be present, all work must cease, and the Corps and USFWS (or NMFS) must be notified. The PASPGP-3 authorization is suspended and will not be re-issued until consultation pursuant to Section 7 of the ESA is concluded and adverse effects to Federally listed threatened, endangered and proposed species and critical habitat are avoided.

Furthermore, persons have an independent responsibility under Section 9 of ESA to not engage in any activity that could result in the "take" of a Federally listed species.
- 4. Spawning Areas.- The permittee shall comply with all time-of-year restrictions as set forth by the PFBC or other designated agency. Discharges or structures in spawning or nursery areas shall not occur during spawning seasons, unless written approval is obtained by the PFBC or other designated agency. In addition, work in areas used for other time sensitive life span activities of fish and wildlife (such as hibernation or migration) may necessitate the use of seasonal restrictions for avoidance of adverse impacts to vulnerable species. Impacts to these areas shall be avoided or minimized to the maximum extent practicable during all other times of the year.
- 5. Waterfowl Breeding and Wintering Areas: Activities including discharges of dredged or fill material or the placerment of structures in breeding and wintering areas of migratory waterfowl must be avoided to the maximum extent practicable.
- 6. Shellfish Production: No discharge of dredged or fill material and/or the placement of structures may occur in areas of concentrated shellfish production, unless the discharge is directly related to an authorized shellfish harvesting activity.
- 7. Adverse Effects From Impoundments: If the activity, including the discharge of dredged or fill material or the placement of a structure, creates an impoundment of water, the adverse effects on the aquatic system caused by the accelerated passage of water and/or the restriction of its flow, including impacts to wetlands, shall be minimized to the maximum extent practicable.
- 8. Obstruction of High Flows: To the maximum extent practicable, the activity'must be designed to maintain pre-construction downstream flow conditions (i.e., location, capacity, and flow rates).
Furthermore, the activity must not permanently restrict or impede the passage of normal or expected high flows (unless the primary purpose of the fill is to impound waters), and the structure or discharge of dredged or fill material must withstand expected high flows. The Activity must, to the maximum extent practicable, provide for retaining excess flows from the site, provide for maintaining surface flow rates from the site similar to pre-construction conditions, and must not increase water flows from the project site, relocate water, or redirect water flow beyond pre-construction conditions. In addition, the activity must, to the maximum extent practicable, reduce adverse effects such as flooding or erosion downstream and upstream of the project site, unless the activity is part of a larger system designed to manage water flows.
- 9. Erosion and Siltation Controls; During construction, appropriate erosion and siltation controls must be used and maintained in effective operating'condition in accordance with State regulations. All exposed soil and other fill material must be permanently stabilized.
- 10. Suitable Material: No activity, including discharges of dredged or fill material or the placement of structures, may consist of unsuitable material, (i.e., asphalt, trash, debris, car bodies, etc.). No material discharged shall contain toxic pollutants in amounts that would violate the effluent limitation standards of § 307 of the CWA-
- 11. Temporary Fill: Temporary fill in waters and wetlands authorized by the PASPGP-3 (i.e., access roads and cofferdams) shall be properly constructed and stabilized during use to prevent erosion and accretion. Temporary fill in wetlands shall be placed on geotextile fabric laid on existing wetland grade.
Whenever possible, rubber or wooden mats should be used for equipment access through wetlands to the project area. Temporary fills shall be removed, in their entirety, to an approved upland site, and suitably contained to prevent erosion and transport to a waterway or wetland. Temporary fill areas shall be restored to their preconstruction contours, elevations, and hydrology and revegetated with comparable native species.
- 12. Equipment Working in Wetlands: Measures must be taken to minimize soil disturbance when heavy equipment is used in and adjacent to wetland areas. These measures include, but are not limited to,
- -avoiding the use of such equipment, use of timber mats or geotextile fabric, :and the use of low pressure tire vehicles.

- 13. Installation and Maintenance: Any structure or fill authorized shall be properly installed and maintained to ensure public safety.
- 14. The Folowing Conditions Apply to Activities for the Maintenance of Existing Flood Control Projects that are authorized Pursuant to PADEP GP-11:
- a. Dredging and channel cleaning are authorized only within the. established limits of the project and only within previously constructed channels. Dredging and channel cleaning shall be limited solely to restoring.channel width and depth to design configurations as clearly described in the baseline maintenance plan.
- b. Dredging must be accomplished using bucket-type equipment when working within the channel, unless siphon-type equipment is necessary in conjunction with a separate, de-watering structure and a clean retum-water procedure is used. In no instance shall sediment be bulldozed or graded within the channel.
- c. A baseline maintenance plan shall be available on-site or at the project sponsor's office. The baseline maintenance plan consists of as-built project plans provided by PADEP or the Corps.
The maintenance plan shall include the name and address of the project sponsor; the name and address of the contractor; a copy of the latest inspection report from PADEP or the Corps; a suitable work plan detailing the length and width (in plan view and cross section) of the intended maintenance work; and current photographs of the work area.
- 15. Permit Expiration: The project-specific PASPGP-3 authorization is valid for the same period as the project-specific PADEP authorization, not to exceed 3 years from the date of authorization, unless modified or extended or until the PASPGP-3 expires, is suspended, or revoked, whichever date occurs sooner.
PASPGP-3 authorization for activities receiving PADEP General Permits shall not exceed 3 years or until the PASPGP-3 expires, is suspended, or revoked, whichever date occurs sooner. Activities authorized under the PASPGP-3 that have commenced construction or are under contract to commence construction will remain authorized provided the activity is completed within 12 months of the date of the PASPGP-3's expiration, modification, or revocation; or until the expiration date of the project specific verification, whichever is sooner.
- 16. One-Time Use: A project-specific PASPGP-3 authorization is valid to construct the project, or perform the activity, one time only, except for maintenance activities associated with the authorized activity, if allowed as part of the authorized activity.
- 17. Water Supply Intakes: No activity,_including discharges of dredged or fill material and/or the placement of structures, may occur in the proximity of a public water supply intake except where the activity or discharge is for repair of the public water supply intake structures or adjacent bank stabilization.
- 18. Cultural Resources: For all activities authorized under a PASPGP-3, upon the discovery of the presence of previously unknown Historic Properties (historic or archaeological), all work must cease and the permittee must notify the SHPO and the Corps of Engineers. The PASPGP-3 authorization is suspended until it is determined, through the Section 106 consultation process, whether the activity will have an affect on the Historic Property. The suspended authorization under PASPGP-3 may be reactivated or modified, through special conditions if necessary, after an affects determination on the Historic Property is made. The PASPGP-3 authorization may be revoked for the specific activity if an adverse affect on the Historic Property can not be avoided or mitigated.
- 19. Tribal Rights: No activity or its operation may impair reserved tribal rights, including, but not limited to, reserved water rights and treaty fishing and hunting rights.
- 20. Corps Civil Works Projects: Navigation Projects. The PASPGP-3 does not authorize interference with any Corps navigation project. The permit-tee understands and agrees that, if future operations by the United States require removal, relocation, or other alteration, of the structure or work herein authorized, or it, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall 3,
cause unreasonable obstruction to the free navigation of the navigable'waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. 'No claim shall be made against the United States on account of any such removal, relocation, or alteration. Other Corps Civil Works Projects (i.e., Flood Control, Dams, and Reservoirs). The PASPGP-3 does not authorize interference with any proposed or existing Federal project. 21., Navigation: No activity authorized under PASPGP-3 may cause more than a minimal adverse affect on navigation. No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the activity authorized herein. In addition,. activities that require temporary causeways that prohibit continued navigational use of a waterway (i.e., temporary causeways extending greater than %the width across the waterway) shall be removed in their entirety upon completion of their use; andshall be clearly marked for'purposes ofpublicsafety. Nothing-in the PASPGP-3 shall in any way restrict the Corps of Engineers from exercising the legal authority to protect the federal interest in navigation and in the navigation servitude of the United States.
- 22. Inspections: The permittee shall allow a District Engineer or his authorized representative(s) to make periodic inspections at any time deemed necessary in order to ensure that the work is being performed in accordance with all the terms and conditions of the PASPGP-3.. The District Engineer may also require post-construction engineering drawings (as-built plans) for completed work.
- 23. Compliance Certification: A compliance certification form, regarding the PASPGP-3 authorized work and required mitigation, will be forwarded to each permittee with the PASPGP-3 authorization. Every permittee, who receives a written PASPGP-3 authorization, shall submit the signed compliance certification form upon completion of the authorized work and required mitigation. The completed form
- shall be returned to the appropriate Corps District and include:
- a. A statement that the authorized work was or was not done in accordance with the PASPGP-3 authorization, including any general and/or special conditions. If the work was not done in accordance with the PASPGP-3 authorization, the permittee shall describe the specifics of the deviation from the authorized activity.
- b. A statement that any required mitigation was or was not done in accordance with the permit conditions and approved plans. If the mitigation was not performed in accordance with the permit conditions and approved plans, the perrnittee shall describe the specifics of the deviation from the permit conditions and plans related to the required mitigation.
- c. Photographs with written descriptions, showing completed authorized work and mitigation, as
-required by the terms of the compliance certification form.
- d. The signature of the permittee, certifying the completion (or not) of the authorized work and mitigation.
- 24. Permit Modifications: Any proposed modification of the authorized project that results in a change in the authorized impact to, or use of waters of the United States, including jurisdictional wetlands, must be approved by PADEP. Corps approval is also required if the project had been previously reviewed.by the Corps or the proposed modification causes the project impacts to exceed 1.0 acre of waters of the United States, including jurisdictional wetlands, or 250 linear feet of streams, rivers, or other jurisdictional waterbodies including open water areas. Project modifications that cause total project impacts to exceed 1.0 acre of waters of the United States, including jurisdictional wetlands, are not eligible 'for PASPGP-3 and will be forwarded to the Corps for processing through alfernate permit procedures.
- 25. Recorded Conservation Instruments: As per Part III. A. Activity 22 and Part mI. B.'Activity 4, proposed conservation instruments may be submitted by the applicant as part of the permit application package. When such proposed conservation instruments are submitted by the applicant, verification of the recorded deed restriction, conservation easement, or deed restricted open space area shall be forwarded to the appropriate Corps District and appropriate PADEP offices, prior to the initiation of any permitted work.

Pursuant to you request, checks were made for the occurrence of juvenile American shad on the intake screens of the Susquehanna Steam Electric Station (22 Aug-14 Oct 1983) and the Hunlock Steam Electric Station (17 Aug-14 Oct 1983). Personnel from Ichthyological Associates conducted the survey at Susquehanna and plant staff from UGI monitored their own screens at Hunlock. At both power plants, screens were washed three times daily (once per 8-hour shift). At Susquehanna, cumulative washes were checked for fish once each day, Monday through Frida7 (washes from Saturday and Sunday were included in the Monday wash). At Runlock, each wash was checked for fish while it was in progress. No junvile shad were collected at either power plant during these surveys. During April through mid-June this year, a total of 25,721 American shad were collected in the fish lifts at Conowingo Dam. Of these, 15,386 were transported and released above York Haven Dam at Middletown, PA with about a 92% survival rate. Most fish were taken during May. Juvenile shad collections in the vicinity of Columbia and Wrightsville in late July and August indicated successful spawning in this vicinity. Our pastanalyses of adult shad movements following release at Middletown showed only modest upstream migration, with some fish reaching Sunbury on the mainstem and Lewistown on the Juniata River. Considering the relatively advanced stage of maturation of most fish and with the peak of abundance occurring late in the season, it is doubtful that shad successfully migrated into the North Branch in 1992. For these reasons I do not believe it is necessary to sample for juvenile shad at the cooling water intakes of the Susquehanna SES at Beach Haven this fall. We appreciate your continued interest and PP&L's involvement with this program. The situation regarding likelihood of shad reproduction near your facility will be reevaluated each year. SRAFRC contractors collected about 13,400 American shad at Conowingo Dam during May 4 - June 15, 1993. Of these, about 11,400 were transported and released above all dams at Middletown, PA. Based on early season juvenile collections in the lower river, we expect that most spawning occurred in the river reach from Columbia to Harrisburg, PA. Interestingly, spawning schools were observed in the Juniata River in late June. Because of the late capture season and relatively small number of adult shad released above dams in 1993, I would not expect that substantial numbers of spawning fish migrated beyond Sunbury. Therefore, it is not necessary for PP&L to monitor intake screens at Susquehanna SES for juvenile shad this fall. If your consultants do collect any juvenile shad in the North Branch during routine surveys, I would appreciate having them frozen for otolith analysis. During late April through early June, 1994, about 32,300 American shad were collected at Conowingo Dam and most of these were transported to release sites at Middletown and Columbia, PA. Large numbers of shad were observed in the Juniata River, but I received no record of fish being taken near Sunbury or points further north. Also, with the inflation of the Sunbury fabridam in mid-May, few shad released below Harrisburg would have had time to reach North Branch waters before danmixnng. Considering these limitations, and the likelihood that little spawning could have occurred near PP&L's Susquehanna SES at Beach Haven, I do not recommend sampling for shad at that site this fall. Definitions. Words and terms that are not otherwise defined in this permit shall have the meanings set forth in Section 3 of the Air Pollution Control Act (35 P.S. § 4003) and in 25 Pa. Code § 121.1.

Operating Permit Duration. (a) This operating permit is issued for a fixed term of five (5) years and shall expire on the date specified on Page 1 of this permit. (b) The terms and conditions of the expired permit shall automatically continue pending issuance of a newoperating
- permit, provided the permittee has submitted a timely and complete application and paid applicable fees required under
- 25 Pa. Code Chapter 127, Subchapter I and the Department is unable, through no fault of the permittee, to issue or deny a new permit before the expiration of the previous permit.

Permit Renewal.
* (a) The permittee shall submit a timely and complete application for renewal of the operating permit to the appropriate .* Regional Air Program Manager. The application for renewal of the operating permit shall be submitted at least six (6)
- months and not more than 18 months beforelthe expiration date of this permit.
* '(b) The application for permit renewal shall include the current permit number, a description of any permit revisions that occurred during the permit term, and any applicable requirements that were promulgated and not incorporated into the permit during the permit term. An application is complete if it contains sufficient information to begin processing the
- application, has the applicable sections completed and has been signed by a responsible official.
. (c) The permittee shall submit with the renewal application a fee for the processing of the application and an additional annual administrative fee as specified in 25 Pa. Code § 127.703(b) and (c). The fees shall be made payable to "The Commonwealth of Pennsylvania - Clean Air Fund" and shall be for the amount specified in the following schedule specified in 25 Pa. Code § 127.703(b) and (c). * .: (1) Three hundred dollars for applications filed during the 2000-2004 calendar years.
(2) Three hundred seventy-five dollars for applications filed for the calendar years beginning in 2005.
-(d) The renewal application shall also include submission of proof that the local municipality and county, in which the . facility is located, have been notified in accordance with 25 Pa. Code § 127.413.
(e) The application for renewal of the operating permit shall also include submission of supplemental compliance review f/forms in accordance with the requirements of 25 Pa. Code § 127.412(b) and § 127.4120). (f) The permittee, upon becoming aware that any relevant facts were omitted or incorrect information was submitted in the permit application, shall promptly submit such supplementary facts or corrected information as necessary to address any requirements that become applicable to the source after the permittee submits a complete application, but prior to the date the Department takes action on the permit application.

(a) The permittee shall pay fees according to the following schedule specified in 25 Pa. Code § 127.703(b):
" (1) Three hundred dollars for applications filed during the 2000-2004 calendar years.
(2) Three hundred seventy-five dollars for applications filed for the calendar years beginning in 2005. This fee schedule shall apply to the processing of an application for an operating permit as well as the extension,
- modification, revision, renewal, and re-issuance of each operating permit or part thereof.

(b) The permittee shall pay an annual operating permit administrative fee according to the fee schedule established in 25 Pa. Code § 127.703(c). (1) Two hundred fifty dollars for applications filed during the 199541999 calendar years. (2) Three hundred dollars for applications filed during the 2000-2004 calendar years. (3) Three hundred seventy-five dollars for applications filed during the years beginning in 2005. (c) The applicable fees shall be made payable to "The Commonwealth of Pennsylvania - Clean Air Fund".

Transfer of Operating Permits.., ,, (a) This operating permit may not be transferred to another person, except in cases of transfer-of-ownership that are documented and approved by the Department. (b) In accordance with 25 Pa. Code § 127.450(a)(4), a change in ownership of the source shall be treated as an. administrative amendment if the Department determines that no other change in the permit is required and a written' agreement has been submitted to the Department identifying the specific date of the transfer of permit responsibility, coverage and liability between the current and the new permittee and a compliance review form has been submitted to,.* and the permit transfer has been approved by, the Department. (c) This operating permit is valid only for those specific sources and the specific source locations described in this permit..
#006 [25 Pa. Code § 127.441 and 35 P.S. § 40081 Inspection and Entry.
(a) Upon presentation of credentials and other documents as may be required by law, the permittee shall allow the Department or authorized representatives of the Department to perform the following: (1) Enter at reasonable times upon the permittee's premises where a source is located or emissions related activity is conducted, or where records are kept under the conditions of this permit; (2) Have access to and copy, at reasonable times, any records that are kept under the conditions of this permit; (3) Inspect at reasonable times, any facilities, equipment including monitoring and air pollution control equipment, practices, or operations regulated or required under this permit; 'N (4) Sample or monitor, at reasonable times, any substances or parameters, for the purpose of assuring compliance with the permit or applicable requirements as authorized by the Clean Air Act, the Air Pollution Control Act, or the regulations promulgated under the Acts.

(b) Pursuant to 35 P.S. § 4008, no person shall hinder, obstruct, prevent or interfere with the Department or its personnel in the performance of any duty authorized under the Air Pollution Control Act or regulations adopted thereunder including denying the Department access to a source at this facility. Refusal of entry or access may constitute grounds for permit revocation and assessment of criminal and/or civil penalties. (c) Nothing in this permit condition shall limit the ability of the EPA to inspect or enter the premises of the permittee in . accordance with Section 114 or other applicable provisions of the Clean Air Act.

Compliance Requirements. (a) The permittee shall comply with the conditions of this operating permit. Noncompliance with this permit constitutes. a violation of the Clean Air Act and the Air Pollution Control Act and is grounds for one or more of the following:. .(b) A person may not cause or permit the operation of a source which is subject to 25 Pa. Code Article IlI unless the source(s) and air cleaning devices identified in the application for the plan approval and operating permit and the plan approval issued for the source is operated and maintained in accordance with specifications in the applications and the conditions inthe plan approval and operating permit issued by the Department. A person.may not cause or permit the operation of an air contamination source subject to 25 Pa. Code Chapter 127 in a manner inconsistent with good operating practices.
(c) For purposes of Sub-condition (b) of this permit condition, the specifications in applications for plan approvals and operating permits are the physical configurations and engineering design details which the Department determines are essential for the permittee's compliance with the applicable requirements in this State-Only permit. Nothing in this sub-condition shall be construed to create an independent affirmative duty upon the permittee to obtain a predetermination from the Department for physical configuration or engineering design detail changes made by the permittee.

Need to Halt or Reduce Activity Not a Defense.
. It shall not be a defense for the permittee iman enforcement action that it was necessary to halt or reduce the permitted activity in order to maintain compliance with the conditions of this permit. #009 (25 Pa. Code §§ 127.442(a) & 127.461]
Duty to Provide Information. (a) The permittee shall submit reports to the Department containing information the Department may prescribe relative to the operation and maintenance of each source at the facility. (b) The permittee shall furnish to the Department, in writing, information that the Department may request to determine whether cause exists for modifying, revoking and reissuing, or terminating this permit, or to determine compliance with the permit. Upon request, the permittee shall also furnish to the Department copies of records that the permittee is required to maintain in accordance with this permit.

This operating permit may be modified, revoked, reopened and reissued or terminated for cause if one or more of the followingapplies: (a) The permittee constructs or operates the source subject to the operating permit so that it is in violation of the Air Pollution Control Act, the Clean Air Act, the regulations thereunder, a plan approval, a permit or in a manner that causes air pollution.
,(b) The permittee fails to properly or adequately maintain or repair an air pollution control device or equipment attached to or otherwise made a part of the source. * (c) The permittee has failed to submit a report required by the operating permit or an applicable regulation.
(d) The EPA determines that the permit is not in compliance with the Clean Air Act or the regulations thereunder.

De Minimis Emission Increases. (a) This permit authorizes de minimis emission increases in accordance with 25 Pa. Code § 127.449 so long as the permittee provides the Department with seven (7) days prior written notice before commencing any de minimis emissions increase. The written notice shall: (1) Identify and describe thepollutants that will be emitted as a result of the de minimis emissions increase. (2) Provide emission rates expressed in tons per year and in terms necessary to establish compliance consistent with-any applicable requirement. (b) The Department may disapprove or condition de minimis emission increases at any time. (c) Except as provided below in (d), the permittee is authorized to make de minimis emission increases (expressed in tons per year) up to the following amounts without the need for a plan approval or prior issuance of a permit modification: (1) Four tons of carbon monoxide from a single source during the term of the permit and 20 tons of carbon monoxide at the facility during the term of the permit. (2) One ton of NOx from a single source during the term of the permit and 5 tons of NOx at the facility during the term of the permit. (3) One and six-tenths tons of the oxides of sulfur from a single source during the term of the permit and 8.0 tons of oxides of sulfur at the facility during the term of the permit. (4) Six-tenths of a ton of PM10 from a single source during the term of the permit and 3.0 tons of PM10 at the facility during the term of the permit. This shall include emissions of a pollutant regulated under Section 112 of the Clean Air Act unless precluded by the Clean Air Act, the regulations thereunder or 25 Pa. Code Article III. (5) One ton of VOCs from a single source during the term of the permit and 5.0 tons of VOCs at the facility during the J'term of the permit. This shall include emissions of a pollutant regulated under Section 112 of the Clean Air Act unless precluded by the Clean Air Act, the regulations thereunder or 25 Pa. Code Article Ill. (6) Other sources and classes of sources determined to be of minor significance by the Department. (d) In accordance with § 127.14, the permittee is authorized to install the following minor sources without the need foi-a plan approval or permit modification: (1) Air conditioning or ventilation systemsmnot designed to remove pollutants generated or released from other sources. (2) Combustion units rated at 2,500,000 or less Btu per hour of heat input. (3) Combustion units with a rated capacity of less than 10,000,000 Btu per hour heat input fueled by natural gas supplied by a public utility or by commercial'fuel oils which are No. 2 or lighter, viscosity less than or equal to 5.82 c St, and which meet the sulfur content requirements of 25 Pa. Code §123.22 (relating to combustion units). For purposes of this permit, commercial fuel oil shallbe virgin oil which has no reprocessed, recycled or waste material added. (e) This permit does not authorize de minimis emission increases if the emissions increase would cause one or more of the following: (1) Increase the emissions of a pollutant regulated under Section 112 of the Clean Air Act except as authorized in Subparagraphs (c)(4) and (5) of this permit condition.
* '(2) Subject the facility to the prevention of significant deterioration requirements in 25 Pa. Code Chapter 127, Subchapter D and/or the new source review requirements in Subchapter E.
(3) Violate any applicable requirement of this permit, the Air Pollution Control Act, the Clean Air Act, or the regulations promulgated under either of the acts.
" () Emissions authorized under this permit condition shall be included in the monitoring, recordkeeping and reporting requirements of this permit. * (g) Except for de mninimis emission increases, installation of minor sources made pursuant to this permit condition and Plan Approval Exemptions under 25 Pa. Code § 127.14 (relating to exemptions), the permittee is prohibited from making changes or engaging in activities that are not specifically authorized under this permit without first applying for a plan approval. In accordance with § 127.14(b), a plan approval is not required for the construction, modification, reactivation, or installation of the sources creating the de minimisemissions increase.
(h) The permittee may not meet de minimis emission threshold levels by offsetting emission increases or decreases at the same source.

(a) When needed to protect public health, welfare and the environment from emissions of hazardous air pollutants from, new and existing sources, the permittee shall comply with the health risk-based emission standards or operating practice, requirements imposed by the Department, except as precluded by §§ 6.6(d)(2) and (3) of the Air Pollution Control Act [35 P.S. § 4006.6(d)(2) and (3)].

Circumvention. Code Article III, except that with prior approval of the Department, the device or technique may be used for control of malodors.

The certifications submitted under this permit shall require a responsible .official of the facility to certify that based on information and belief formed after reasonable inquiry, the statements and information in the documents are true, accurate and complete. (e) Any records, reports or information submitted to the Department shall be available to the public except for such records, reports or information which meet the confidentiality requirements of § 4013.2 of the Air Pollution Control Act and §§ 112(d) and 114(c) of the Clean Air Act. The permittee may not request a claim of confidentiality for any emissions data generated for the facility.

Emissions from material in or on trucks, railroad cars and other vehicular equipment are not considered as emissions from use of roads and streets. (4) Clearing of land. (5) Stockpiling of materials. Open burning operations (a) No person may permit the open burning of material in an area outside of air basins in a manner that: (1) The emissions are visible, at any time, at the point such emissions pass outside the property of the person on whose land the open burning is being conducted. (2) Malodorous air contaminants from the open burning are detectable outside the property of the person on whose land the open burning is being conducted. (3) The emissions interfere with the reasonable enjoyment of life or property. (4) The emissions cause damage to vegetation or property. (5) The emissions are or may be deleterious to human or animal health. (b) Exceptions: The requirements of subsections (a) do not apply where the open burning operations result from: (1) A fire set to prevent or abate a fire hazard, when approved by the Department and set by or under the supervision of a public officer. (2) A fire set for the purpose of instructing personnel in fire fighting, when approved by the Department. (3) A fire set for the prevention and control of disease or pests, when approved by the Department. (4) A fire set in conjunction with the production of agricultural commodities in their unmanufactured state on the premises of the farm operation. (5) A fire set for the purpose of burning domestic refuse, when the fire is on the premises of a structure occupied solely as a dwelling by two families or less and when the refuse results from the normal occupancy of such structure. (6) A fire set solely for recreational or ceremonial purposes. (7) A fire set solely for cooking food. 1I, TESTING REQUIREMENTS.

(v) Sample collection techniques employed, including procedures used, equipment descriptions and data to verify that isokinetic sampling for particulate matter collection occurred and that acceptable test conditions were met. (vi) Laboratory procedures and results. (vii) Calculated results. III. MONITORING REQUIREMENTS.
