In Reference 1, the Nuclear Regulatory Commission (NRC) documented tlu-ee apparent violations against DTE Electric Company (DTE) that it is considering for escalated enforcement action in accordance with the NRC Enforcement Policy. Also in Reference 1, the NRC concluded that the apparent violations have very low security significance (green). The NRC letter provided DTE with the opportunity to (1) request a Pre-Enforcement Conference (PEC),

(2) participate in Alternative Dispute Resolution (ADR) or (3) to submit a written response to the NRC regarding the apparent violations. DTE appreciates the opportunity to respond to the NRC on this issue. Mr. Steven O1ih, Division of Reactor Safety, was verbally notified on May 7, 2020 of DTE's intent to submit a written response on this matter and not to request a PEC or participate in ADR. This letter further documents that DTE intends to submit our position on the proposed findings and apparent violations to the NRC in writing, as allowed by the NRC in Reference 1. As the letter was received by DTE on April 29, 2020, DTE will respond to the NRC ' s apparent violations within 30 days ofreceipt, which is by May 29, 2020.
