DI)CKETS 50-266 AND 50-301 TECHNICAL SPECIFICATIONS CHANGE REOUEST 197 DESIGNATION OF CHIEF NUCLEAR OFFICER POINT BEACH NUCLEAR PLANT. UNITS 1 AND 2 In accordance with the requirements of 10 CFR 50.4 and 10 CFR 50.90, Wisconsin Electric Power Company, Licensee for the Point Beach Nuclear Plant, Units 1 and 2, hereby requests amendments to Facility Operating Licenses DPR-24 and DPR-27, respectively. The requested amendments will incorporate changes to the plant Technical Specifications.

The requested amendments amend Technical Specification Section 15.6.2.1.c to change the title of the corporate officer responsible for nuclear operations from the "Vice President-Nuclear Power,"

to the " Chief Nuclear Officer." In addition, the requirement that this position be an officer of the Company will be added. This will allow upgrading the position of the corporate officer responsible for overall nuclear operations without limiting the title. Changes are also being proposed for Technical Specifications Sections 15.6.7," Actions To Be Taken If A Safety Limit Is Exceeded," 15.6.6, " Reportable Event Action," and 15.7.8," Administrative Controls."

Wisconsin Electric Power Company (Company) recently altered its organizational structure.

Under the new structure the overall responsibility for nuclear safety previously vested in the Vice President - Nuclear Power, as stipulated in Technical Specification 15.6.2.1.c, has been transferred to the President - Wisconsin Electric Power Company who has been appointed the Chief Nuclear Officer. The proposed changes ensure responsibility for the overall safe operation of the Point Beach Nuclear is maintained and provide for consistency throughout the Specifications.

A description of the proposed changes, a safety evaluation, no significant hazards determination,

and marked-up Technical Specifications pages with the proposed changes are attached.

4 We have determined that the proposed changes are administrative only and therefore meet the categorical exclusion criteria set forth in 10 CFR 51.22 (c) (10). In accordance with 10 CFR 51.22 (b) an environmental assessment or impact statement need not be prepared. Altematively, Wisconsin Electric Power Company requests the Nuclear Regulatory Commission to issue and publish a finding of no significant environmental impact pursuant to 10 CFR 51.21,51.32 and 51.35.

4 jlcscription and Reason for Propnsed Chances Technical Specifications Change Reauest 197 Designation of Chief Nuclear Officer Point Beach Nuclear Plant. Units I and 2 The present Technical Specifications requirements for the Vice President Nuclear Power are as follows:

15.6.2.1.c "The Vice-President - Nuclear Power shall have corporate responsibility for overall plant nuclear safety and shall take any measures needed to ensure acceptable performance of the staffin operating, maintaining, and providing technical support to the plant to ensure nuclear safety."

15.6.6.B Each Reportable Event shall be reviewed by the Manager's Supervisory Staff (MSS) and submitted to the Off-Site Review Committee (OSRC) and the Vice President -

Nuclear Power.

15.6.7.B "An immediate report shall be made to the Vice President - Nuclear Power and Chairman of the Off-Site Review Committee.

15.6.7.C "The Vice President - Nuclear Power shall report the circumstances to the NRC.

15.6.7.D "A safety Limit Violation Report including a complete analysis of the circumstances leading to and resulting from the occurrence, effects upon facility components, systems or structures, together with recommendations to prevent a recurrence, shall be prepared.

This report shall be submitted to the Vice President - Nuclear Power and the Chairman of the Off-Site Review Committee. A safety Limit Violation Report shall be submitted to the NRC by the Vice President - Nuclear Power within 10 days of the occurrence.

15.7.8.2.C The results of the audits in A and B above shall be transmitted to the Vice President -

Nuclear Power and the Chairman of the Off-Site Review Committee.

The proposed amendments revise these requirements as follows:

The proposed amendments support the appointment of the appropriate officer of the company directly responsible for the safe operation of the Point Beach Nuclear Plant. The position will not be limited by title. The officer appointed to the position will have access and control over the resources necessary to carry out this function. As an officer of the Company, the Chief Nuclear Officer will be appointed by the Chief Executive Officer. The proposed changes ensure responsibility for the overall safe operation of the Point Beach Nuclear Plant is maintained and provide for consistency throughout the Specifications.

Safety Evaluation f Technical Snecifications Chance Reauest 197 Designation of Chief Nuclear Officer Point Beach Nuclear Plant. Units I and 2 i

) Wisconsin Electric Power Company, licensee for Point Beach Nuclear Plant, Units 1 and 2, has i requested amendments to Facility Operating Licensed DPR-24 and DPR-27, respectively. The purpose of the amendments is to reflect current organization within the Technical Specifications without limiting i

the title of the individual responsible for the overall safe operation of the Point Beach Nuclear Plant.

i The individual responsible for the overall safe operation of the Point Beach Nuclear Plant will remain an 1 officer of the Company. This will ensure that the individual in the position has control over the j necessary resources to effectively discharge the assigned responsibilities. The proposed changes also provide for consistency thought the Technical Specification.

1 l The proposed changes are administrative only and do not alter any Commission requirement. The j facility and its operation is not modified. There are no changes to Security Plan, Emergency Planning or Quality Assurance requirements. Management oversight of the facility is maintained.

i There is no change in facility effluents or any other radiological or non-radiological impact of the

facility and its environs. Therefore, the health and safety of the public is maintained by the proposed changes.

Point Beach Nuclear Plant. Units 1 and 2 Wisconsin Electric Power Company, licensee for the Point Beach Nuclear Plant, has evaluated the proposed amendments in accordance with the requirement of 10 CFR 50.91(a)(1), against the standards in 10 CFR 50.92, and has determined that the operation of the Point Beach Nuclear Plant in accordance with the proposed amendments involves no significant hazards consideration. The proposed changes are administrative only. As discussed in the Statements of Consideration for 10 CFR Part 2 and Part 50 published at 51 FR. 7744, dated March 6,1986, purely administrative changes are not likely to involve significant hazards considerations. An amendment which involves purely administrative changes such as those proposed here," presents no safety questions and clearly involves no significant hazards considerations." N.R.C. 69,77, n. 6 (1992). The evaluation against each of the standards in 10 CFR 50.92 follows:  ;

1. Operation of the Point Beach Nuclear Plant in accordance with the proposed amendments will not result in a significant increase in the probability or consequences of an accident previously evaluated.

l The proposed changes are administrative only. There are no physical changes to the facility or its operation. All Limiting Conditions of Operation, Limiting Safety System Settings, and Safety Limits specified in the Technical Specification remain unchanged. Additionally, there are no changes in the I Quality Assurance Program, Emergency Plan, Security Plan, and Operator Training and Requalification Program. Therefore, an increase in the probability or consequences of an accident previously evaluated cannot occur.

2. Operation of the Point Beach Nuclear Plant in accordance with the proposed amendments will not create the possibility of a new or different kind of accident from any accident previously evaluated.

The proposed changes are administrative only. No changes to the facility structures, systems and components or their operation will result. The design and design basis of the f acility remain unchanged. The plant safety analyses remain current and accurate. No new or different failure mechanisms are introduced. Therefore, the possibility of a new or different kind of accident from any accident previously evaluated is not introduced.

3. Operation of the Point Beach Nuclear Plant in accordance with the proposed amendments does not involve a significant reduction in a margin of safety.

The proposed amendments are administrative only. All safety margins established through the design and facility license including the Technical Specifications remain unchanged. In addition, the proposed amendments ensure continued emphasis and assignment of responsibility for overall nuclear safety. Therefore, all margins of safety are maintained.
