Dear Dr. Murley:

In accordance with the Code of Federal Regulations, Title 10, Sections 50.59 and 50.90, IES Utilities Inc. hereby requests revision of Operating License DPR-49 and-Technical Specifications for the Duane Arnold Energy Center (DAEC).

The proposed amendment will record that the name of the company licensed to own a share of and operate the DAEC has changed. The NRC was previously advised of this change by References 1 and 2 and the NRC acknowledged'the change in Reference 3. The company name, formerly Iowa Electric Light and Power Company (IELP), is now IES Utilities Inc. The other utility owned by IES Industries, Inc. (Iowa Southern Utilities company) was merged into IELP and the name of the corporation was changed. The proposed amendment also changes the title of one position. 1 Responsibility for operation of the DAEC remains with the Nuclear j Division but the title of the position responsible for management )

The operating company name change was effective January 1, 1994. -

The final organization and titles within IES Utilities Inc. have not .!

Evaluation of Change With Respect to 10 CFR 50.92 i

Background:

IES Industries owned two electric utility subsidiaries: Iowa Electric Light and Power Company (IELP) and Iowa Southern Utilities Company (Iowa Southern).- Iowa Southern was merged into IELP and the corporation was renamed IES Utilities Inc. .Under this corporation, the Nuclear Division will continue as before. The DAEC Operating License and Technical Specifications must lx3 revised to reflect'the new name of the corporation.

In addition to the new corporate name, the title of a position has.

been changed. The position responsible for management of the Nuclear Division has been changed from " Manager-Nuclear Division" to "Vice President, Nuclear."

These changes do not result in any changes to the management or operation of the DAEC.

The proposed' license amendment would revise the DAEC Operating License ~

and Technical Specifications to change " Iowa Electric Light and Power Company" and "IELP" to "IES Utilities Inc." and the title " Manager-Nuclear Division" to "Vice President, Nuclear."

Basis for proposed no significant hazards consideration:

The Commission has provided standards (10 CFR 50.92(c)) for determining whether a significant hazards consideration exists. .A proposed amendment to an operating license for a facility involves no significant hazards consideration if operation of the facility in accordance with the proposed amendment would not (1) involvo a significant increase in the probability or consequences of an accident previously evaluated; (2) create the possibility of a new or different-kind of accident from any accident previously evaluated; or (3) involve a significant reduction in a margjn of safety.

In reviewing this proposed request for Operating License and Technical Specifications change, we have reached these conclusions:

1) The proposed amendment does not involve a'significant increase in the probability or consequences of an accident previously evaluated. No physical or operational changes to the,DAEC will result from changing the corporate name or the position title.

The DAEC will continue"to be operated in the same manner with the same organization. The position title change results from~the elimination of a layer of management. Formerly, the Manager-
