FORT CALHOUN STATION, UNIT NO. 1 ACCEPTANCE OF REQUESTED LICENSING ACTION RE: LICENSE AMENDMENT REQUEST TO REVISE THE LICENSE TERMINATION PLAN (L-2024-LLA-0095)

Dear Benjamin Pearson:

By letter dated June 18, 2024 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML24177A132), and as supplemented by letter dated October 2, 2024 (ML24276A217). Omaha Public Power District (OPPD or the licensee) requested the U.S.

Nuclear Regulatory Commission (NRC) to approve a request to amend the license for Fort Calhoun Station, Unit No. 1 (FCS). The amendment would approve a revision of the FCS License Termination Plan (LTP) which was approved by license amendment dated January 31, 2024 (ML24019A145).

The FCS LTP provides the details of the plan for characterizing the site, identifying remaining dismantlement activities, and remediating the remaining residual radioactivity at FCS to a level that complies with the NRCs radiological criteria for license termination. The FCS LTP also describes how the licensee will confirm the extent and success of remediation through radiological surveys, provide financial assurance to complete decommissioning, and ensure the environmental impacts of the decommissioning activities are within the scope originally envisioned in the associated environmental documents. The proposed amendment would amend the LTP to revise the dose calculation for the Auxiliary Building basement, the requirements for remediation, and survey methodologies in the LTP.

The purpose of this letter is to provide the results of the NRC staffs initial administrative and acceptance review of the submittal. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

The NRC has reviewed your application as supplemented and concludes that it does provide technical information in sufficient detail to enable the NRC to initiate its detailed technical review in support of making an independent assessment regarding the acceptability of this request in terms of regulatory requirements and the protection of public health and safety and the environment. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRCs ability November 18, 2024

to complete the detailed technical review are identified despite completion of an adequate acceptance review.

Based on the information provided in your submittals, the NRC staff has estimated that this license amendment request will take approximately 1000 hours0.0116 days <br />0.278 hours <br />0.00165 weeks <br />3.805e-4 months <br /> to complete. The NRC staff expects to complete this review in approximately 7 months from the date of this letter. If there are emergent complexities or challenges in our review that would cause changes to the initial estimated completion date, the reasons for the change, along with a new estimate, will be communicated during the routine interactions with the project manager. This estimate is based on the NRC staffs initial review of the application and it could change, due to several factors including requests for additional information, unanticipated addition of scope to the review, and review by NRC advisory committees or hearing-related activities.

In the review of the application, NRC environmental staff identified that a categorical exclusion from the environmental considerations for this license amendment request would not be appropriate and that NRC staff would need to complete an environmental assessment to approve the request. To support development of an environmental assessment by NRC, an updated Supplemental Environmental Report is needed from OPPD. Therefore, please provide the additional information described in the enclosure.

To assist us in scheduling the NRC staff review of your response, we request that you provide this information 30 calendar days from the date of this letter. Inform us at your earliest convenience if you are not able to provide the information by that time frame. If you are unable to provide a response by the stated date, our review may be delayed.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs Agencywide Documents Access and Management System (ADAMS).
