In Reference 1, pursuant to 10 CFR 50.55a(g)(5)(iii), Duke Energy Carolinas, LLC (Duke Energy) requested U.S. Nuclear Regulatory Commission (NRC) approval of relief request number RA-22-0024 to American Society of Mechanical Engineers (ASME)Section XI Code requirements for McGuire Nuclear Station (MNS) Unit 1. Specifically, Duke Energy requested relief from paragraphs IWA-2200 and IWB-2500 for volumetric examination of certain class 1 components on the basis that conformance with these ASME Section XI Code requirements is impractical as conformance would require extensive structural modifications to the component or surrounding structure. The Reference 1 relief request was approved by the NRC via the Reference 2 safety evaluation.
Framatome Inc. (Framatome) has identified that the Reference 1 relief request contains information proprietary to Framatome. Therefore, it is requested that Reference 1 be removed from the public docket and replaced with this submittal. The same two enclosures from Reference 1 are provided with this submittal, however, the difference being that this submittal provides both a redacted and proprietary version of Enclosure 2. Enclosure 1 provides the details of relief request number RA-22-0024 and Enclosure 2 includes non-destructive examination (NDE) data and coverage plots detailing the examination limitations in support of relief request number RA-22-0024. In accordance with 10 CFR 2.390, it is requested that the proprietary version of Enclosure 2 be withheld from public disclosure. An Affidavit signed by

The McGuire Nuclear Station (MNS), Unit 1 Fourth Inservice Inspection Interval is based on the American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel (B&PV) Code,Section XI, 2007 Edition through the 2008 Addenda.
MNS, Unit 1 maintains the responsibility to ensure exams were performed in accordance with the requirements of ASME,Section XI, Appendix VIII, Performance Demonstration for Ultrasonic Examination Systems, as amended and mandated by 10 CFR 50.55a. In the case of limited examinations, efforts were made to obtain additional examination coverage. Table 1 identifies if the examinations were performed in accordance with the requirements of ASME,Section XI, Appendix VIII.
3.0 APPLICABLE CODE REQUIREMENTS:
3.1.
ASME Section XI Examination Category B-A The extent of examination requirement for Examination Category B-A, Item Number B1.11, per Table IWB-2500-1, requires a volumetric examination of all Circumferential Shell Welds, as shown in Figure IWB-2500-1.
The extent of examination requirement for Examination Category B-A, Item number B1.12, per Table IWB-2500-1, requires a volumetric examination of all Longitudinal Shell Welds as shown in Figure IWB-2500-2.
3.2.
ASME Section XI Examination Category B-D The extent of examination requirement for Examination Category B-D, Item Number B B3.110, per Table IWB-2500-1, requires a volumetric examination of all Pressurizer Nozzle-to-Vessel welds as shown in Figure IWB-2500-7(b).

ASME Section XI Examination Method IWA-2200(c)
In accordance with ASME Section XI, IWA-2200(c), all nondestructive examinations of the required examination surface or volume shall be conducted to the maximum extent practical. When performing VT-1, surface, radiographic, or ultrasonic examination on a component with defined surface or volume, essentially 100% of the required surface or volume shall be examined. Essentially 100% coverage is achieved when the applicable examination coverage is greater than 90%; however, in no case shall the examination be terminated when greater than 90% coverage is achieved, if additional coverage of the required examination surface or volume is practical.
4.0 IMPRACTICALITY OF COMPLIANCE:
Pursuant to 10 CFR 50.55a(g)(5)(iii), relief is requested on the basis that conformance with these ASME Section XI Code requirements is impractical as conformance would require extensive structural modifications to the component or surrounding structure.
10 CFR 50.55a recognizes the limitations to Inservice Inspection of components in accordance with the ASME Section XI Code that are imposed due to early plants' design and construction. A design modification would be required to obtain ASME Code-required coverage. Therefore, it is impractical for MNS Unit 1 to satisfy the ASME Section XI code requirements to perform a volumetric examination of the components listed in Table 1 due to the physical component configuration, single sided access, and interference from permanent plant equipment.
Table 1 provides a summary of the examination limitations for each component for which relief is requested. Table 1 also indicates the outage the component was examined, the coverage percentage obtained for each component, and other pertinent design information. This table is the cumulative list of the limited ASME Section XI examinations performed during the fourth ISI interval. Enclosure 2 provides non-destructive examination (NDE) data and coverage plots that detail the examination limitations.
Accordingly, pursuant to 10 CFR 50.55a(g)(5)(iii), Duke Energy has determined that conformance with the code requirement of essentially 100% coverage of weld volume or area examined was impractical due to various constraints and limitations as stated above.
Duke Energy requests NRC approval of the proposed alternative as stated below.
5.0 BURDEN CAUSED BY COMPLIANCE:
Compliance with the applicable ASME Section XI Code volumetric examination requirements can only be accomplished by redesigning and refabricating the subject and/or surrounding components. Based on this, the ASME Section XI Code requirements are deemed impractical in accordance with 10 CFR 50.55a(g)(5)(iii).

On the basis that obtaining the required examination coverage is impractical due to physical obstructions and limitations imposed by original plant design and fabrication, no alternative examination for additional ultrasonic testing (UT) examination coverage is proposed.
Radiography (RT) is not a desired option because it is limited in its ability to detect service-induced flaws. Use of other manual or automated UT techniques, whether conventional or phased array, were considered, but would not increase coverage due to limitation created by the component configuration.
Based on the volumetric coverage obtained, along with the completed ASME Code required surface examination and System Pressure Tests, it is reasonable to conclude that if significant service induced degradation were occurring, it would have been evident by the examinations and testing that were performed. Duke Energy has determined that volumetric examinations performed to the extent practical provide reasonable assurance of structural integrity of the subject welds.
6.1.
Examination Category B-A MNS Unit 1 has performed the ASME Section XI Code required examinations to the maximum extent practical (Code Coverage), which are documented in Table 1. In most exams, examination was limited due to the location of Core Stop Lugs below the welds consistent with previous exams. One examination was limited due to interference of the outlet nozzle boss, also consistent with previous exams. Due to the design of the reactor vessel and location of the Core Stop Lugs and Outlet Nozzle Boss causing these limitations, there are no alternative examination techniques currently available to increase coverage. In addition, VT-2 visual examinations associated with the Class 1 leakage test are performed each refueling outage. The volume of coverage obtained during the UT examinations along with ongoing leakage tests every refueling outage provide reasonable assurance that any flaw(s) that might have propagated through the subject welds are identified and dispositioned through the corrective action program. Additionally, any flaw(s) detected were evaluated as acceptable per Enclosure 2. Thus, Duke believes the completed exams provide an acceptable level of quality and safety.

Examination Category B-D MNS Unit 1 has performed the ASME Section XI Code required examinations to the maximum extent practical (Code Coverage), which are documented in Table 1. The design of the pressurizer includes heater wells, which limit the available scanning area and nozzle geometry to single-sided access. This is consistent with previous exams.
There are no alternative examination techniques currently available to increase coverage.
In addition, VT-2 visual examinations associated with the Class 1 leakage test are performed each refueling outage. The volume of coverage obtained during the UT examinations along with ongoing leakage tests every refueling outage provide adequate assurance that any flaw(s) that might have propagated through the subject welds are identified and dispositioned through the corrective action program. Additionally, any flaw(s) detected were evaluated as acceptable per Enclosure 2. Thus, Duke believes the completed exams provide an acceptable level of quality and safety.

The circumferential welds and longitudinal welds were examined from four orthogonal beam directions to the maximum extent practical in accordance with the criteria defined in 10 CFR 50.55a(b)(2)(xv)(G) and the minimum coverage requirements defined in 10 CFR 50.55a(b)(2)(xv)(K). In those areas where there are no obstructions to limit probe(s) movement, all four directions of data are reviewed for both Zone 1 and Zone 2. Zone 1 is defined as the inner 15% of the vessel wall thickness, measured from the clad to base material interface. Zone 2 is defined as the outer 85% of the vessel wall thickness. Thus, Zone 2 begins at the end of Zone 1 and extends to 100% of the component wall thickness. If there is an obstruction that limits one direction of movement, the opposing direction (non-limited) can be used to claim full coverage. This is allowed because the vendors demonstration utilized signal side access.
However, this single sided coverage is utilized only for Zone 2 (outer 85%t); Zone 1 (inner 15%t) is required to be covered from four orthogonal directions.

My name is Philip A. Opsal. I am Manager, Product Licensing for Framatome and as such I am authorized to execute this Affidavit.

I am familiar with the criteria applied by Framatome to determine whether certain Framatome information is proprietary. I am familiar with the policies established by Framatome to ensure the proper application of these criteria.

I am familiar with the Framatome information contained in Enclosure 2 (Relief Request Number RA-22-0024, McGuire Nuclear Station, Unit 1 Fourth Inservice Inspection (ISI)
Interval Limited Coverage Non-Destruction Examination (NDE) Data and Coverage Plots) marked as Framatome Proprietary Information herein referred to as Document. Information contained in this Document has been classified by Framatome as proprietary in accordance with the policies established by Framatome for the control and protection of proprietary and confidential information.

This Document contains information of a proprietary and confidential nature and is of the type customarily held in confidence by Framatome and not made available to the public. Based on my experience, I am aware that other companies regard information of the kind contained in this Document as proprietary and confidential.

This Document has been made available to the U.S. Nuclear Regulatory Commission in confidence with the request that the information contained in this Document be withheld from public disclosure. The request for withholding of proprietary information is made in accordance with 10 CFR 2.390. The information for which withholding from disclosure is requested qualifies under 10 CFR 2.390(a)(4) Trade secrets and commercial or financial information.

The following criteria are customarily applied by Framatome to determine whether information should be classified as proprietary:
(a)
The information reveals details of Framatomes research and development plans and programs or their results.
(b)
Use of the information by a competitor would permit the competitor to significantly reduce its expenditures, in time or resources, to design, produce, or market a similar product or service.
(c)
The information includes test data or analytical techniques concerning a process, methodology, or component, the application of which results in a competitive advantage for Framatome.
(d)
The information reveals certain distinguishing aspects of a process, methodology, or component, the exclusive use of which provides a competitive advantage for Framatome in product optimization or marketability.
(e)
The information is vital to a competitive advantage held by Framatome, would be helpful to competitors to Framatome, and would likely cause substantial harm to the competitive position of Framatome.
The information in this Document is considered proprietary for the reasons set forth in paragraphs 6(b), 6(c), 6(d) and 6(e) above.

In accordance with Framatomes policies governing the protection and control of information, proprietary information contained in this Document has been made available, on a limited basis, to others outside Framatome only as required and under suitable agreement providing for nondisclosure and limited use of the information.

Framatome policy requires that proprietary information be kept in a secured file or area and distributed on a need-to-know basis.
