3 MR. RAKOVAN: All right. So, I'm 4 not planning to use a microphone tonight given 5 that this is a small space. I'm assuming you 6 can all hear me.

7 Excellent. I will ask though, I'm 8 going to have my other speakers come up here in 9 turn. And then, when we move to the public 10 commenting and questioning portion of the 11 meeting, I will ask that if you speak you do 12 come up here primarily because our court 13 reporter is -- has a device up here.

14 So, that way, if you're here and 15 you're speaking clearly, she should be able to 16 pick you up.

17 So, with that, for all of you who 18 don't know, I'm Lance Rakovan. I am the Senior 19 Environmental Project Manager for Perry License 20 Renewal.

21 I'd like to welcome you to tonight's 22 public meeting hosted by the USNRC, Nuclear 23 Regulatory Commission. Vaughn Thomas is also 24 here. He is the Safety Project Manager and 25 will be speaking.

4 1 And, we also have Ted Smith, who is 2 my boss. He is the Chief of the Environmental 3 Review License Renewal Branch.

4 Our goals today, we have two. To 5 provide you with an overview of the license 6 renewal process, touching on the safety side, 7 with a focus on the environmental side for the 8 license renewal of Perry.

9 And also, to get your input in terms 10 of the scope of the environmental issues that 11 the NRC should address as part of the 12 environmental review.

13 A term that I'm going to be using 14 tonight a lot, is scoping. Which means the --

15 essentially determining the scope of the 16 environmental review in this case again, for 17 Perry License Renewal.

18 Today's meeting is just one way that 19 you can provide your scoping comments. And, I 20 will be going into more detail on other ways 21 that you can provide those comments as well as 22 we progress.

5 1 finished with our presentation, we'll see if 2 any of you in attendance have clarifying 3 questions. We want to make sure that you fully 4 understand the information that we cover. And 5 then, we'll go ahead and open up the floor to 6 scoping comments.

7 We did have the sign in sheet. And, 8 I see a few of you did sign up to provide 9 comments. We can certainly, we'll start with 10 those and then if anyone else here would like 11 to provide comments at that time, we'll 12 certainly open the floor to that.

13 I believe we have the meeting 14 scheduled to 8:30 tonight. I know we have a 15 drop-dead, lights out time at 9:00 when they 16 shut the library down.

17 So, we are actively looking for your 18 scoping comments tonight. This is a comment 19 gathering meeting by NRC's definition, which 20 means that we are actively seeking your input.

21 Please note that we are transcribing 22 our meeting so that we can make sure that we 23 get a full accounting of the comments that you 24 provide once we get to that point in the 25 meeting.

6 1 Again, as I said earlier, Vaughn 2 Thomas is with us. He is the -- he's my safety 3 counterpart. And, Ted Smith is here. And, I 4 think this is the time, Ted, if you wanted to 5 give some opening remarks. Why don't you come 6 up here to make sure we get you.

13 MR. SMITH: All right. So, thanks 14 Lance. Good evening everyone. Thanks for 15 being here. As he said, my name's Ted Smith.

16 I am the Chief of the Environmental License 17 Renewal Branch in the Rulemaking, Environmental 18 and Financial Services Division at the Nuclear 19 Regulatory Commission.

20 I'd like to welcome you to tonight's 21 meeting for the Perry Nuclear Power Plant 22 License Renewal Application.

23 This is the second scoping meeting.

24 The first meeting was a virtual meeting held on 25 October 19.

7 1 As Lance and Vaughn will detail 2 later, our review process has always encouraged 3 both public participation and transparency.

4 Public participation, openness, and 5 transparency are core values of the NRC.

6 The licensing of a nuclear facility 7 is conducted in an open and transparent manner.

8 The public will be informed and have an 9 opportunity to participate in the regulatory 10 process.

11 This public scoping meeting today is 12 one way we encourage this participation. I'm 13 looking forward to hearing your feedback from 14 the participants here on significant issues 15 that you feel are important for the staff to 16 consider in our detailed analysis of the 17 environmental issues to be included in our 18 review.

19 Our goal is to hear from you, 20 collect your comments so we can fully consider 21 them in our review. Thank you in advance for 22 your participation.

2 With that, I'll turn it back over to 3 you, Lance. Thank you.

4 MR. RAKOVAN: Thanks Ted. So, Perry 5 Unit One was first licensed in November 1986.

6 The current renewed license expires in November 7 2026. If a license renewal is granted, it will 8 be for an additional 20 years.

9 Energy Harbor -- oh. Oh, I'm sorry.

10 Energy Harbor Nuclear Corp. filed an 11 application for license renewal in a letter 12 dated July 3 of this year.

13 The license renewal application is 14 required to contain certain sets of 15 information, general information such as the 16 applicant's name and such, business and 17 administrative information, technical 18 information pertaining to aging management, 19 which is more the focus of the safety review, 20 and of course, an environmental report, which 21 is the Applicant's assessment of the 22 environmental impacts of continued operation.

23 This information serves as the 24 starting point for the NRC staff to review the 25 environmental aspects of license renewal for NEAL R. GROSS COURT REPORTERS AND TRANSCRIBERS 1323 RHODE ISLAND AVE., N.W.

2 I'll now ask Vaughn Thomas to come 3 up and talk on a few slides about the safety 4 review.

5 MR. THOMAS: Okay. Thank you, 6 Lance. And, good evening. Once again, my name 7 is Vaughn Thomas and I'm the Safety Project 8 Manager for the Perry License Renewal review.

9 On the -- I think you went a little 10 bit too far. But, go back. It's around, but I 11 can take it from this slide, no problem.

12 Once again, my name is Vaughn 13 Thomas. And, I will talk us through the 14 license renewal, initial license renewal and 15 review process as shown on this slide.

16 The slide that I had on there shows 17 the --

18 MR. RAKOVAN: Hold up. I mean, this 19 is the same one, isn't it the same one from the 20 -- it should be the same one from virtual. I 21 apologize if it's wrong.

22 MR. THOMAS: It should be this one.

23 But, that's okay.

10 1 this one, and I just did the other.

2 MR. THOMAS: No.

3 MR. RAKOVAN: Probably my bad.

4 Okay.

5 MR. THOMAS: That's okay. But, the 6 slides are similar. So, we'll talk from there.

7 So, typically, the flow chart 8 highlights the license renewal process, which 9 includes prior reviews, one is a safety review, 10 which is the top. And, the environmental 11 review, which is the second one in the middle.

12 And, typically, during this process, 13 the public has the opportunity to request a 14 hearing.

15 And, what happens during that time 16 frame, the staff presents its safety evaluation 17 report or findings to ACRS, where ACRS then 18 provide their recommendations to the Commission 19 as to whether or not to grant or issue a 20 license.

21 As part of the environmental review, 22 the staff consults with the local, state, and 23 federal and tribal officials. And the staff 24 will hold public meetings to receive comments 25 on the draft environmental impact statement.

11 1 MR. RAKOVAN: I think you're going 2 backwards.

3 MR. THOMAS: Sorry. Okay. That 4 slide was just up earlier. So, I apologize for 5 that. I need the next slide. So, this is 6 correct.

7 So, this, the Atomic Energy Act 8 authorizes the NRC to issue licenses for 9 commercial nuclear power plants for up to 40 10 years. And the licensees can then renew for an 11 additional 20 years at a time.

12 This period following the initial 13 license, the licensing term is also known as 14 the extended period of operation.

15 The purpose of the safety review is 16 to one, identify aging effects that can impair 17 the ability of systems, structures, and 18 components within the scope of license renewal 19 to perform their intended functions.

20 And, to demonstrate that these aging 21 effects will be adequately managed during the 22 period of extended operation. This scope has 23 not changed for initial license renewal or to 24 subsequent license renewal.

12 1 2023, Perry submitted the subsequent license 2 renewal application. After receiving the 3 application, the NRC conducted an acceptance 4 review.

5 The NRC then determined that Energy 6 Harbor's application was sufficient. The 7 application was accepted for docketing on 8 September 29, 2023.

9 Then, we move onto our technical 10 review, which includes the aging management 11 audit. The aging management audit consists of 12 three parts.

13 One, the in-office technical review 14 audit that's currently taking place. And, we 15 just had the onsite audit today. And, we'll 16 have one later on next month. And then, also, 17 next month, we'll also have the breakout audit.

18 During all phases of the audit, the 19 NRC staff reviews the application documents and 20 references in greater detail. As part of the 21 safety review, the staff also reviews the 22 Applicant's operating experience for 23 information applicable to aging management.

24 Following the audit, an audit report 25 is issued. At the very end, the staff will NEAL R. GROSS COURT REPORTERS AND TRANSCRIBERS 1323 RHODE ISLAND AVE., N.W.

13 1 conduct its review on the safety evaluation or 2 SER.

3 The NRC ensures the adequate 4 protection of public health and safety and the 5 environment through a regulatory process, which 6 is shown on this slide here. The regulatory 7 process consists of five major components.

8 One will be to develop regulations 9 and guidance for applications and licensees.

10 The license or certify applicants to either 11 these materials, nuclear materials, operating 12 nuclear facilities, or decommission.

13 We also oversee the license 14 operations in facilities to ensure that 15 licensees comply with safety requirements. And 16 we also evaluate operational experience at a 17 licensed facility or involving license 18 activities.

19 And, in support of our regulatory 20 decisions, we conduct research, hold hearings 21 to address the concerns of parties affected by 22 the agency decisions, and obtain independent 23 reviews.

14 1 management, as shown on the red block and 2 arrow.

3 Now, I will turn the meeting back to 4 Lance who will discuss the environmental 5 review. Lance?

6 MR. RAKOVAN: Sorry about that 7 slide.

8 MR. THOMAS: No problem.

9 MR. RAKOVAN: All right. So, 10 focusing on the environmental review, the 11 National Environmental Policy Act, or NEPA 12 obligates federal agencies to consider 13 environmental impacts in federal actions.

14 The NRC's specific environmental 15 regulations can be found in 10 CFR, our code of 16 Federal Regulations, Part 51.

17 The objective of our environmental 18 review is to determine if the environmental 19 impacts of license renewal are so great that 20 license renewal would not be a reasonable 21 option. Or, more plainly, if license renewal 22 is unacceptable from an environmental 23 standpoint.

24 Our environmental review consists --

25 considers the impacts of continuing to operate NEAL R. GROSS COURT REPORTERS AND TRANSCRIBERS 1323 RHODE ISLAND AVE., N.W.

15 1 the plant for an additional 20 years and any 2 proposed mitigation to those impacts as 3 warranted.

4 We also consider the impacts of 5 reasonable alternatives to the proposed action 6 of license renewal, including the impacts of 7 not issuing a renewed license.

8 The staff documents its 9 environmental review in an environmental impact 10 statement or EIS. The staff has developed a 11 generic environmental impact statement or GEIS, 12 that addressed a number of issues common to all 13 nuclear power plants.

14 The staff is supplementing that 15 generic EIS, or GEIS, with a site-specific EIS, 16 in which we will address issues that are 17 specific to Perry Nuclear Power Plant.

18 The staff also reexamines the 19 conclusions reached in that GEIS to determine 20 if there is any new and significant information 21 that would change those conclusions.

22 For license renewal review, the NRC 23 looks at a wide range of environmental impacts 24 as part of preparing the environmental impact 25 statement. This is kind of a list of those, or NEAL R. GROSS COURT REPORTERS AND TRANSCRIBERS 1323 RHODE ISLAND AVE., N.W.

16 1 at least a sampling of those.

2 And then, my next slide is more of a 3 graphical way of looking at those. Again, this 4 is not a comprehensive list. It's just some of 5 the main categories of things that we look at 6 in terms of our environmental review.

7 In conducting our environmental 8 review, we coordinate and consult with various 9 local, state, federal, and tribal officials and 10 gather pertinent information from these sources 11 to ensure it is considered in our analysis.

12 As illustrated on this slide about 13 consulting agencies, examples include the U.S.

14 Fish and Wildlife Service, the Environmental 15 Protection Agency, State Historical 16 Preservation Officer, and so on.

17 As part of the environmental review, 18 the NRC staff may hold public meetings such as 19 this one, to receive comments such as scoping 20 comments. Or, also to receive comments on the 21 draft environmental impact statement once it is 22 issued.

23 The environmental review begins with 24 the scoping process that we're currently 25 conducting. The purpose of the process is to NEAL R. GROSS COURT REPORTERS AND TRANSCRIBERS 1323 RHODE ISLAND AVE., N.W.

17 1 identify significant issues that should be 2 considered in the environmental review.

3 We are gathering information that we 4 will use to prepare the environmental impact 5 statement for license renewal. And, as part of 6 that process, we're here today to collect your 7 input, that is, the environmental impacts that 8 the staff should consider.

9 The scoping period started on 10 October 10th when a Notice of Intent to Prepare 11 an Environmental Impact Statement and conduct 12 scoping was published in the Federal Register.

13 The NRC will be accepting comments on the scope 14 of the environmental review until November 9th.

15 Any comments that we receive after 16 that time, we will attempt to incorporate as 17 part of our processes, but we cannot guarantee 18 we will be able to do so.

19 In general, we are looking for 20 information about environmental impacts from 21 the continued operation of Perry during the 22 period of extended operation.

23 You can assist us in that process by 24 telling us for example, what aspects of your 25 local community we should focus on, what local NEAL R. GROSS COURT REPORTERS AND TRANSCRIBERS 1323 RHODE ISLAND AVE., N.W.

18 1 environmental, social, and economic issues the 2 NRC staff should examine during the 3 environmental review, and what reasonable 4 alternatives are most appropriate for this 5 local region.

6 These are just some of the examples 7 of the input that we are looking for. And, 8 they represent the kinds of information we are 9 seeking through the environmental scoping 10 period.

11 Your comments today would be helpful 12 in providing insights of this nature for the 13 environmental analysis.

14 Here are a few of the important 15 milestones for the environmental review 16 process. And, if you have environmental 17 scoping comments you would like to submit 18 outside of today's meeting, again, you have 19 until November 9th to do so if at all possible.

20 Please note that we plan to issue a 21 draft supplemental environmental impact 22 statement for public comment in August of next 23 year. This is another way again, that members 24 of the public can be involved in our processes.

19 1 provide comments on the draft environmental 2 impact statement. While this slide lists 3 milestones for the environmental review and 4 opportunities for public involvement, the 5 safety review will be performed in accordance 6 with a separate schedule.

7 So, again, our primary points of 8 contact for Perry relicensing at the NRC are 9 Vaughn as the Safety PM, myself as the 10 Environmental PM, and then, Scott Wall is the 11 Operating Reactor Project Manager at NRC 12 Headquarters. And, our contact information is 13 provided on this slide.

14 The Perry Public Library has agreed 15 to make license renewal materials available.

16 We will be providing them with a copy of the 17 application.

18 And then, we will also be providing 19 them with a copy of the draft environmental 20 impact statement once that is available next 21 year. So, that if you do wish to come look at 22 a hard copy of the document, you will be able 23 to see that here.

5 So again, we're looking for scoping 6 comments here tonight. But, here are other 7 ways that you can provide them. You can 8 provide them in written form to our Office of 9 Administration, that's Washington, D.C. 20555.

10 You can go to their website, 11 Regulations.gov and search for NRC-2023-0136.

12 Or, you can send an email to 13 PerryEnvironmental@NRC.gov.

14 We do have some cards over here on 15 the table that have those links and QR codes, 16 at least to the Regulations.gov and to a few of 17 the other materials. That's an easy way that 18 you can pick this up.

19 Or again, you can find a link to 20 these slides on the public meeting schedule 21 page for this meeting.

22 Again, I'll stress that we hope to 23 receive your scoping comments by November 9th.

23 1 want to say, I have the greatest respect for 2 people who work at the power plant. I know 3 some of them.

4 I know people who worked there 5 during construction. One of my dearest 6 neighbors was one of those people, a pipe 7 fitter.

8 And, I have -- I have concerns 9 though. I have concerns about flooding. I 10 don't know if there have been studies done 11 recently.

12 But, you know, because of the 13 climate change, we've had a lot more rain.

14 And, a lot heavier rain. And, of course, this 15 comes into the circumstance of erosion. We're 16 on the lake. The lake erosion has been 17 horrible. Just awful.

18 So, I want -- I really hope that in 19 your scope you will take those things into 20 consideration. I'm also concerned about 21 Tritium being released as a hazard for the lake 22 for the people who drink the water, like me and 23 like probably everybody else here.

24 1 repairs. And, I'm worried about the 2 inaccessible parts of the plant that can't be 3 reviewed by modeling or, you know, general data 4 inspections.

5 Those are pretty much my main 6 concerns, the flooding. Oh, and then we have 7 earthquakes. Now, when -- I lived in 8 California for six years. I know about 9 earthquakes.

10 The problem is, when we have an 11 earthquake, and especially ones that are over 12 the 3.5 magnitude, the ground water has a 13 potential for change.

14 And, this is, you know, this is 15 pretty normal. Except that Perry is not a 16 normal plant. And, the location is not a 17 normal situation.

18 So, I think those are my basic 19 concerns. And, I'm really concerned for the 20 people who work there, who have a significant 21 stake in the safety and the perpetuation of 22 their jobs and of the, you know, general 23 environmental concerns for the entire 24 community.

10 Davis. Okay. As -- I'll just bring up the 11 slide. And, we have moved onto the scoping 12 comments.

13 We only have one other individual 14 who has signed up to speak tonight. That would 15 be Michael Wyatt.

16 Michael, if you'd like the podium, 17 please?

18 MR. WYATT: Sure. So, I am a 19 citizen. I'm not associated with the plant in 20 any direct way or indirect way.

21 The -- and, I've lived in this area, 22 not Perry, but I lived in Painesville Township 23 for a number of years. And, I've lived in 24 Perry now since -- 12 years.

26 1 plant. I'm a big fan of nuclear power. I 2 believe it's important to us going forward in 3 this country.

4 I'm not anti-nuclear power at all.

5 The -- so, I fully support continuing the 6 operation of the plant.

7 One of the concerns that I have 8 concerns, there's a problem with silt. There 9 is some radioactive silt material that's in 10 storage in the plant.

11 I'd be interested to know how much.

12 But, I understand it's in the millions of 13 pounds. And, as to how it's stored.

14 My understanding is that it's pools, 15 open pools within the plant. It's also under 16 the unused cooling tower number two, I believe, 17 is the correct terminology for it.

18 And, the silt has been there since 19 the plant started operating and through several 20 changes in management of the plant, nothing has 21 ever been done to clean it up because of 22 kicking the can down the road so to speak.

23 Because it costs a lot of money, I'm sure, to 24 do that.

25 So, the silt is exposed to the NEAL R. GROSS COURT REPORTERS AND TRANSCRIBERS 1323 RHODE ISLAND AVE., N.W.

27 1 ground. And, I'm sure that there are liners.

2 I understand some of the liners are rubber or 3 plastic. And, the one under the cooling tower, 4 I understand is concrete.

5 But, the status of that concrete 6 after what, 30 years, I'm not sure about that.

7 I don't know if they have a way, if we have a 8 way to correct that.

9 The silt comes from being, coming 10 back into the piping that exits to Lake Erie.

11 And, it builds up and periodically my 12 understanding is that divers go down and remove 13 it.

14 And, it's being put in the op --

15 into these ponds, whatever you would call them, 16 as well as under the cooling tower number two.

17 So, if we continue down this avenue, 18 it seems to me we probably should build another 19 cooling tower to store it under. Or, just 20 build more pools.

21 So, I think those are probably bad 22 alternatives. My -- what I think should be 23 done, is I think that as a condition of the 24 renewal and/or the condition of the possible 25 sale of the plant to another operator, it NEAL R. 28 1 should be, that material should be removed.

2 And, a plan should be in place to 3 remove that material going forward as long as 4 the plant is operating. Instead of just 5 storing it.

6 I want to make sure I cover what.

7 So, I guess we call it contaminated silt, as an 8 issue. Thank you.

10 Davis, I just, I had a thought. And, I did a 11 quick check. The Federal Register Notice that 12 came out as part of our acceptance, notifying 13 that we had formally accepted the application 14 for Perry License Renewal for docketing, that 15 also included a deadline to request for a 16 hearing or a petition for leave.

17 And, that's the November 28th date.

18 So, yes, I had a thought and yes, I thought 19 that was correct. So, that's where the 20 November 28th date comes from.

11 And then, you know, kind of look at 12 each -- each of my subject matter experts will 13 be looking at the comments in their specific, 14 you know, topics.

15 So, please send them in. We will 16 analyze them. If we -- if you have your name 17 on the sign in sheet, we'll make sure that you 18 receive a copy of that scoping summary report 19 once we issue it.

20 And, that will be issued and will be 21 referenced as part of the draft environmental 22 impact statement, which again, we are hoping to 23 issue next August.
