not planning to use a microphone tonight given 4
that this is a small space. I'm assuming you 5
can all hear me.
6 Excellent. I will ask though, I'm 7
going to have my other speakers come up here in 8
turn. And then, when we move to the public 9
commenting and questioning portion of the 10 meeting, I will ask that if you speak you do 11 come up here primarily because our court 12 reporter is -- has a device up here.
13 So, that way, if you're here and 14 you're speaking clearly, she should be able to 15 pick you up.
16 So, with that, for all of you who 17 don't know, I'm Lance Rakovan. I am the Senior 18 Environmental Project Manager for Perry License 19 Renewal.
20 I'd like to welcome you to tonight's 21 public meeting hosted by the USNRC, Nuclear 22 Regulatory Commission. Vaughn Thomas is also 23 here. He is the Safety Project Manager and 24 will be speaking.

my boss. He is the Chief of the Environmental 2
Review License Renewal Branch.
3 Our goals today, we have two. To 4
provide you with an overview of the license 5
renewal process, touching on the safety side, 6
with a focus on the environmental side for the 7
license renewal of Perry.
8 And also, to get your input in terms 9
of the scope of the environmental issues that 10 the NRC should address as part of the 11 environmental review.
12 A term that I'm going to be using 13 tonight a lot, is scoping. Which means the --
14 essentially determining the scope of the 15 environmental review in this case again, for 16 Perry License Renewal.
17 Today's meeting is just one way that 18 you can provide your scoping comments. And, I 19 will be going into more detail on other ways 20 that you can provide those comments as well as 21 we progress.
22 So, after some opening
- remarks, 23 again, we will be providing an overview of the 24 license renewal process. Once the NRC is 25

understand the information that we cover. And 4
then, we'll go ahead and open up the floor to 5
scoping comments.
6 We did have the sign in sheet. And, 7
I see a few of you did sign up to provide 8
comments. We can certainly, we'll start with 9
those and then if anyone else here would like 10 to provide comments at that
- time, we'll 11 certainly open the floor to that.

believe we have the meeting 13 scheduled to 8:30 tonight. I know we have a 14 drop-dead, lights out time at 9:00 when they 15 shut the library down.
16 So, we are actively looking for your 17 scoping comments tonight. This is a comment 18 gathering meeting by NRC's definition, which 19 means that we are actively seeking your input.
20 Please note that we are transcribing 21 our meeting so that we can make sure that we 22 get a full accounting of the comments that you 23 provide once we get to that point in the 24 meeting.

12 MR. SMITH: All right. So, thanks 13 Lance. Good evening everyone. Thanks for 14 being here. As he said, my name's Ted Smith.
15 I am the Chief of the Environmental License 16 Renewal Branch in the Rulemaking, Environmental 17 and Financial Services Division at the Nuclear 18 Regulatory Commission.
19 I'd like to welcome you to tonight's 20 meeting for the Perry Nuclear Power Plant 21 License Renewal Application.
22 This is the second scoping meeting.
23 The first meeting was a virtual meeting held on 24 October 19.

both public participation and transparency.

- openness, and 4
transparency are core values of the NRC.
5 The licensing of a nuclear facility 6
is conducted in an open and transparent manner.
7 The public will be informed and have an 8
opportunity to participate in the regulatory 9
process.
10 This public scoping meeting today is 11 one way we encourage this participation. I'm 12 looking forward to hearing your feedback from 13 the participants here on significant issues 14 that you feel are important for the staff to 15 consider in our detailed analysis of the 16 environmental issues to be included in our 17 review.
18 Our goal is to hear from you, 19 collect your comments so we can fully consider 20 them in our review. Thank you in advance for 21 your participation.

1 With that, I'll turn it back over to 2
you, Lance. Thank you.
3 MR. RAKOVAN: Thanks Ted. So, Perry 4
Unit One was first licensed in November 1986.
5 The current renewed license expires in November 6
2026. If a license renewal is granted, it will 7
be for an additional 20 years.
8 Energy Harbor -- oh. Oh, I'm sorry.
9 Energy Harbor Nuclear Corp.
filed an 10 application for license renewal in a letter 11 dated July 3 of this year.
12 The license renewal application is 13 required to contain certain sets of 14 information, general information such as the 15 applicant's name and
- such, business and 16 administrative information, technical 17 information pertaining to aging management, 18 which is more the focus of the safety review, 19 and of course, an environmental report, which 20 is the Applicant's assessment of the 21 environmental impacts of continued operation.
22 This information serves as the 23 starting point for the NRC staff to review the 24 environmental aspects of license renewal for 25

1 I'll now ask Vaughn Thomas to come 2
up and talk on a few slides about the safety 3
review.
4 MR. THOMAS: Okay. Thank you, 5
Lance. And, good evening. Once again, my name 6
is Vaughn Thomas and I'm the Safety Project 7
Manager for the Perry License Renewal review.
8 On the -- I think you went a little 9
bit too far. But, go back. It's around, but I 10 can take it from this slide, no problem.
11 Once
- again, my name is Vaughn 12 Thomas. And, I will talk us through the 13 license renewal, initial license renewal and 14 review process as shown on this slide.
15 The slide that I had on there shows 16 the --
17 MR. RAKOVAN: Hold up. I mean, this 18 is the same one, isn't it the same one from the 19
-- it should be the same one from virtual. I 20 apologize if it's wrong.
21 MR. THOMAS: It should be this one.
22 But, that's okay.

I 24 apologize. Yep, okay. And, you may change 25

1 MR. THOMAS: No.

Probably my bad.
3 Okay.
4 MR. THOMAS: That's okay. But, the 5
slides are similar. So, we'll talk from there.
6 So, typically, the flow chart 7
highlights the license renewal process, which 8
includes prior reviews, one is a safety review, 9
which is the top. And, the environmental 10 review, which is the second one in the middle.
11 And, typically, during this process, 12 the public has the opportunity to request a 13 hearing.
14 And, what happens during that time 15 frame, the staff presents its safety evaluation 16 report or findings to ACRS, where ACRS then 17 provide their recommendations to the Commission 18 as to whether or not to grant or issue a 19 license.
20 As part of the environmental review, 21 the staff consults with the local, state, and 22 federal and tribal officials. And the staff 23 will hold public meetings to receive comments 24 on the draft environmental impact statement.

backwards.
2 MR. THOMAS: Sorry. Okay. That 3
slide was just up earlier. So, I apologize for 4
that. I need the next slide. So, this is 5
correct.
6 So, this, the Atomic Energy Act 7
authorizes the NRC to issue licenses for 8
commercial nuclear power plants for up to 40 9
years. And the licensees can then renew for an 10 additional 20 years at a time.
11 This period following the initial 12 license, the licensing term is also known as 13 the extended period of operation.
14 The purpose of the safety review is 15 to one, identify aging effects that can impair 16 the ability of
- systems, structures, and 17 components within the scope of license renewal 18 to perform their intended functions.
19 And, to demonstrate that these aging 20 effects will be adequately managed during the 21 period of extended operation. This scope has 22 not changed for initial license renewal or to 23 subsequent license renewal.
24 As previously mentioned, on July 3, 25

renewal application.
After receiving the 2
application, the NRC conducted an acceptance 3
review.
4 The NRC then determined that Energy 5
Harbor's application was sufficient.
The 6
application was accepted for docketing on 7
September 29, 2023.
8 Then, we move onto our technical 9
review, which includes the aging management 10 audit. The aging management audit consists of 11 three parts.
12 One, the in-office technical review 13 audit that's currently taking place. And, we 14 just had the onsite audit today. And, we'll 15 have one later on next month. And then, also, 16 next month, we'll also have the breakout audit.
17 During all phases of the audit, the 18 NRC staff reviews the application documents and 19 references in greater detail. As part of the 20 safety review, the staff also reviews the 21 Applicant's operating experience for 22 information applicable to aging management.
23 Following the audit, an audit report 24 is issued. At the very end, the staff will 25

(202) 234-4433 WASHINGTON, D.C. 20005-3701 (202) 234-4433 conduct its review on the safety evaluation or 1
SER.
2 The NRC ensures the adequate 3
protection of public health and safety and the 4
environment through a regulatory process, which 5
is shown on this slide here. The regulatory 6
process consists of five major components.
7 One will be to develop regulations 8
and guidance for applications and licensees.
9 The license or certify applicants to either 10 these materials, nuclear materials, operating 11 nuclear facilities, or decommission.
12 We also oversee the license 13 operations in facilities to ensure that 14 licensees comply with safety requirements. And 15 we also evaluate operational experience at a 16 licensed facility or involving license 17 activities.
18 And, in support of our regulatory 19 decisions, we conduct research, hold hearings 20 to address the concerns of parties affected by 21 the agency decisions, and obtain independent 22 reviews.
23 With license
- renewals, the 24 regulatory process now considers aging 25

arrow.
2 Now, I will turn the meeting back to 3
Lance who will discuss the environmental 4
review. Lance?
5 MR.
RAKOVAN:

7 MR. THOMAS: No problem.
8 MR. RAKOVAN: All right. So, 9
focusing on the environmental
- review, the 10 National Environmental Policy Act, or NEPA 11 obligates federal agencies to consider 12 environmental impacts in federal actions.
13 The NRC's specific environmental 14 regulations can be found in 10 CFR, our code of 15 Federal Regulations, Part 51.
16 The objective of our environmental 17 review is to determine if the environmental 18 impacts of license renewal are so great that 19 license renewal would not be a reasonable 20 option. Or, more plainly, if license renewal 21 is unacceptable from an environmental 22 standpoint.
23 Our environmental review consists --
24 considers the impacts of continuing to operate 25

(202) 234-4433 WASHINGTON, D.C. 20005-3701 (202) 234-4433 the plant for an additional 20 years and any 1
proposed mitigation to those impacts as 2
warranted.
3 We also consider the impacts of 4
reasonable alternatives to the proposed action 5
of license renewal, including the impacts of 6
not issuing a renewed license.
7 The staff documents its 8
environmental review in an environmental impact 9
statement or EIS. The staff has developed a 10 generic environmental impact statement or GEIS, 11 that addressed a number of issues common to all 12 nuclear power plants.
13 The staff is supplementing that 14 generic EIS, or GEIS, with a site-specific EIS, 15 in which we will address issues that are 16 specific to Perry Nuclear Power Plant.
17 The staff also reexamines the 18 conclusions reached in that GEIS to determine 19 if there is any new and significant information 20 that would change those conclusions.
21 For license renewal review, the NRC 22 looks at a wide range of environmental impacts 23 as part of preparing the environmental impact 24 statement. This is kind of a list of those, or 25

1 And then, my next slide is more of a 2
graphical way of looking at those. Again, this 3
is not a comprehensive list. It's just some of 4
the main categories of things that we look at 5
in terms of our environmental review.
6 In conducting our environmental 7
review, we coordinate and consult with various 8
local, state, federal, and tribal officials and 9
gather pertinent information from these sources 10 to ensure it is considered in our analysis.
11 As illustrated on this slide about 12 consulting agencies, examples include the U.S.
13 Fish and Wildlife Service, the Environmental 14 Protection
- Agency, State Historical 15 Preservation Officer, and so on.
16 As part of the environmental review, 17 the NRC staff may hold public meetings such as 18 this one, to receive comments such as scoping 19 comments. Or, also to receive comments on the 20 draft environmental impact statement once it is 21 issued.
22 The environmental review begins with 23 the scoping process that we're currently 24 conducting. The purpose of the process is to 25

considered in the environmental review.
2 We are gathering information that we 3
will use to prepare the environmental impact 4
statement for license renewal. And, as part of 5
that process, we're here today to collect your 6
input, that is, the environmental impacts that 7
the staff should consider.
8 The scoping period started on 9
October 10th when a Notice of Intent to Prepare 10 an Environmental Impact Statement and conduct 11 scoping was published in the Federal Register.
12 The NRC will be accepting comments on the scope 13 of the environmental review until November 9th.
14 Any comments that we receive after 15 that time, we will attempt to incorporate as 16 part of our processes, but we cannot guarantee 17 we will be able to do so.
18 In
- general, we are looking for 19 information about environmental impacts from 20 the continued operation of Perry during the 21 period of extended operation.
22 You can assist us in that process by 23 telling us for example, what aspects of your 24 local community we should focus on, what local 25

NRC staff should examine during the 2
environmental
- review, and what reasonable 3
alternatives are most appropriate for this 4
local region.
5 These are just some of the examples 6
of the input that we are looking for. And, 7
they represent the kinds of information we are 8
seeking through the environmental scoping 9
period.
10 Your comments today would be helpful 11 in providing insights of this nature for the 12 environmental analysis.
13 Here are a few of the important 14 milestones for the environmental review 15 process. And, if you have environmental 16 scoping comments you would like to submit 17 outside of today's meeting, again, you have 18 until November 9th to do so if at all possible.
19 Please note that we plan to issue a 20 draft supplemental environmental impact 21 statement for public comment in August of next 22 year. This is another way again, that members 23 of the public can be involved in our processes.
24 You will have an opportunity to 25

impact statement. While this slide lists 2
milestones for the environmental review and 3
opportunities for public involvement, the 4
safety review will be performed in accordance 5
with a separate schedule.
6 So, again, our primary points of 7
contact for Perry relicensing at the NRC are 8
Vaughn as the Safety PM, myself as the 9
Environmental PM, and then, Scott Wall is the 10 Operating Reactor Project Manager at NRC 11 Headquarters. And, our contact information is 12 provided on this slide.
13 The Perry Public Library has agreed 14 to make license renewal materials available.
15 We will be providing them with a copy of the 16 application.
17 And then, we will also be providing 18 them with a copy of the draft environmental 19 impact statement once that is available next 20 year. So, that if you do wish to come look at 21 a hard copy of the document, you will be able 22 to see that here.
23 Also, the website listed here is a 24 great place to keep track of a lot of things 25

4 So again, we're looking for scoping 5
comments here tonight. But, here are other 6
ways that you can provide them. You can 7
provide them in written form to our Office of 8
Administration, that's Washington, D.C. 20555.

13 We do have some cards over here on 14 the table that have those links and QR codes, 15 at least to the Regulations.gov and to a few of 16 the other materials. That's an easy way that 17 you can pick this up.
18 Or again, you can find a link to 19 these slides on the public meeting schedule 20 page for this meeting.
21 Again, I'll stress that we hope to 22 receive your scoping comments by November 9th.
23 If we get them a little late, we hopefully will 24 still be able to incorporate them into our 25

One of my dearest 5
neighbors was one of those people, a pipe 6
fitter.
7 And, I have -- I have concerns 8
though. I have concerns about flooding. I 9
don't know if there have been studies done 10 recently.

- But, you
- know, because of the 12 climate change, we've had a lot more rain.
13 And, a lot heavier rain. And, of course, this 14 comes into the circumstance of erosion. We're 15 on the lake. The lake erosion has been 16 horrible. Just awful.
17 So, I want -- I really hope that in 18 your scope you will take those things into 19 consideration.
I'm also concerned about 20 Tritium being released as a hazard for the lake 21 for the people who drink the water, like me and 22 like probably everybody else here.
23 I think that -- I think that this is 24 going to cost a lot more money in terms of 25

- And, I'm worried about the 1
inaccessible parts of the plant that can't be 2
reviewed by modeling or, you know, general data 3
inspections.
4 Those are pretty much my main 5
concerns, the flooding. Oh, and then we have 6
- Now, when I
lived in 7
California for six years. I know about 8
9 The problem is, when we have an 10 earthquake, and especially ones that are over 11 the 3.5 magnitude, the ground water has a 12 potential for change.
13 And, this is, you know, this is 14 pretty normal. Except that Perry is not a 15 normal plant. And, the location is not a 16 normal situation.
17 So, I think those are my basic 18 concerns. And, I'm really concerned for the 19 people who work there, who have a significant 20 stake in the safety and the perpetuation of 21 their jobs and of the, you know, general 22 environmental concerns for the entire 23 community.

17 MR. WYATT: Sure. So, I am a 18 citizen. I'm not associated with the plant in 19 any direct way or indirect way.
20 The -- and, I've lived in this area, 21 not Perry, but I lived in Painesville Township 22 for a number of years. And, I've lived in 23 Perry now since -- 12 years.
24 And so, I'm concerned about the 25

believe it's important to us going forward in 2
this country.
3 I'm not anti-nuclear power at all.
4 The -- so, I fully support continuing the 5
operation of the plant.
6 One of the concerns that I have 7
concerns, there's a problem with silt. There 8
is some radioactive silt material that's in 9
storage in the plant.
10 I'd be interested to know how much.
11 But, I understand it's in the millions of 12 pounds. And, as to how it's stored.
13 My understanding is that it's pools, 14 open pools within the plant. It's also under 15 the unused cooling tower number two, I believe, 16 is the correct terminology for it.
17 And, the silt has been there since 18 the plant started operating and through several 19 changes in management of the plant, nothing has 20 ever been done to clean it up because of 21 kicking the can down the road so to speak.
22 Because it costs a lot of money, I'm sure, to 23 do that.
24 So, the silt is exposed to the 25

1 I understand some of the liners are rubber or 2
plastic. And, the one under the cooling tower, 3
I understand is concrete.
4 But, the status of that concrete 5
after what, 30 years, I'm not sure about that.
6 I don't know if they have a way, if we have a 7
way to correct that.
8 The silt comes from being, coming 9
back into the piping that exits to Lake Erie.

- And, it builds up and periodically my 11 understanding is that divers go down and remove 12 it.
13 And, it's being put in the op --
14 into these ponds, whatever you would call them, 15 as well as under the cooling tower number two.
16 So, if we continue down this avenue, 17 it seems to me we probably should build another 18 cooling tower to store it under. Or, just 19 build more pools.
20 So, I think those are probably bad 21 alternatives. My -- what I think should be 22 done, is I think that as a condition of the 23 renewal and/or the condition of the possible 24 sale of the plant to another operator, it 25

1 And, a plan should be in place to 2
remove that material going forward as long as 3
the plant is operating. Instead of just 4
storing it.
5 I want to make sure I cover what.
6 So, I guess we call it contaminated silt, as an 7
issue. Thank you.

9 Davis, I just, I had a thought. And, I did a 10 quick check. The Federal Register Notice that 11 came out as part of our acceptance, notifying 12 that we had formally accepted the application 13 for Perry License Renewal for docketing, that 14 also included a deadline to request for a 15 hearing or a petition for leave.
16 And, that's the November 28th date.
17 So, yes, I had a thought and yes, I thought 18 that was correct. So, that's where the 19 November 28th date comes from.

19 And, that will be issued and will be 20 referenced as part of the draft environmental 21 impact statement, which again, we are hoping to 22 issue next August.
